EC to Consider EU Resettlement Programme in September (News)

“Addressing the first meeting of the newly-constituted Civil Liberties Committee of the European Parliament [in July], EU Justice Commissioner Jacques Barrot said the Commission was finalising the workings of the first intra-EU resettlement programme and would present it to member states in September for approval.”

“…Malta and Italy are insisting that this pilot-project should be compulsory, in order to force member states to share the burden of the southern EU member states, Mr Barrot said this was not possible under the EU treaties and would therefore have to be on a voluntary basis.”

Barrot “underlined the importance of cooperation with third countries, notably Turkey and Libya. He said that he was urging these countries to embark on patrols to bring illegal departures to a halt, to set up systems for readmission of illegal immigrants and to establish reception centres for asylum seekers in their countries.”

“During the debate the issue of Italy’s new policy of turning back migrants to Libya and its newly adopted law on security measures in the area of immigration were harshly criticised by Socialist MEPs who claimed that Italy was violating its obligations and the rights of migrants through these measures.”

“In response Commissioner Barrot noted that the Commission was studying the compatibility of Italy’s security package with European law, whilst it was also carrying out a survey with Italian authorities on the exact facts surrounding those incidents where it turned migrants back to Libya. He said that the Commission was now waiting for Italy’s response.”

UE demande aux members d’accueillir les demandeurs d’asile échoués sur les côtes maltaises (News)

“Plus de 2 800 immigrés sont arrivés sur les côtes maltaises en 2008.  [Malte] a examiné, cette année-là, 2 685 demandes d’asile et a accordé sa protection à 1 410 demandeurs, selon les chiffres de la Commission [Européenne].

“La Commission a … envisagé trois formules. Soit un groupe de pays présente un projet commun, avec un possible État leader et le soutien éventuel d’une organisation internationale, comme le Haut-Commissariat aux réfugiés de l’ONU (HCR). Soit un pays décide d’agir seul, …mais «s’il s’agit de réinstaller seulement cinq réfugiés dans un État donné, il n’y aura pas d’intérêt à présenter un projet», prévient la Commission en soulignant qu’un pays isolé ne pourrait ne pas être éligible au Fonds européen pour les réfugiés que Bruxelles veut mobiliser. Soit, enfin, les États, seuls ou en groupe, agissent avec le HCR ou l’Organisation internationale pour les migrations (OIM), qui toutes deux ont dit vouloir jouer un rôle actif.”

“Quoi qu’il en soit, Bruxelles ne veut pas perdre de temps : les 27 pays membres de l’Union devront se prononcer mi-septembre, puis un appel à projets sera lancé avant la fin du mois, permettant d’ouvrir la procédure pour les aides à venir.”

EU May Fund “Accommodation Centres” In Libya (News)

EC Vice-President Jacques Barrot said that the EU and Belgium will offer “a financial package of 80 million euros to enable Libya deal with the perennial problem of illegal migration through its territories.”

”He said from the financial package, Libya was expected to use 20 million euros to build accommodation centres for asylum seekers while Brussels would increase its financial aid to Libya to 60 million euros to enable Tripoli manage the illegal immigration through its territories.”

”According to Mr. Barrot, the EU will reach an agreement with Libyan authorities under which people seeking political asylum in Europe can do so from Libya.”

EC Asks Italy for Explanation Regarding Forced Returns (News)

EC Justice Commissioner Jacques Barrot said “the commission had asked the Italian government for explanations on how some boats with irregular migrants, some asking for humanitarian protection, were returned to Libya.”  The EC is trying “to determine whether Italy is breaching obligations set down in international and EU law.”

“We want to know exactly and in detail what happened and what kind of operations were carried out, Barrot’s spokesman said on Monday (20 July). Italy has not been given a deadline by which to reply to the Commission.”

“The UNHCR says at least 900 people have been picked up and sent back to Libya since May, when Italy began its new policy of intercepting boats and returning would-be immigrants.”

“However, Barrot appears to believe that the incident will not be repeated.  I’ve been reassured that there is no perceived need for such operations, because, thanks to [the] agreement between Italy and Libya, far fewer illegal migrants are coming in, he said after meeting [Italy’s interior minister Roberto] Maroni.”

Dublin Regulation Will Not Be Revisited Until 2014 (News)

EC Vice-President Jacques Barrot said that the common European asylum system should be implemented by 2012 at the latest, but the “revision of the Dublin Regulation, which stipulates that migrants apply for asylum in the first EU member state they enter and has resulted in disproportionate pressure on Greece and other southern EU states, will not be considered until 2014.”  Greece and other certain other southern EU states seek an earlier revision to the Dublin Regulation.

European Refugee Fund May Be Used for Economic Migrants as Well as Asylum Seekers (News)

During the recent EU interior and justice ministers meeting in Stockholm, EC Vice President and Justice Commissioner Jacques Barrot agreed “to extend the European Refugee Fund to apply to all incoming migrants, not just those meriting asylum. As a result, several million euros in aid will be set aside for Greece and other Mediterranean states to spend on additional reception centers, food and medical supplies and social support for migrants.”

Frontex: Italy-Libya Agreement has “strong dissuading effect” (News, Statistics)

Frontex deputy director Gil Arias Fernandez said that the economic crisis has caused a drop in the number of migrants coming to the EU and that the Italy-Libya migration agreement has also had “a very strong dissuading effect.”  “When you see people who have spent a lot of money on their journey, who have faced great danger during the sea crossing, come back having been expelled from the country of arrival, you think twice before undertaking a similar voyage.”

Frontex reports a 16% reduction in the overall number of irregular migrants stopped at EU borders over the past year.  Sicily and Lampedusa experienced a 54% reduction in migrants over the first six months of 2009 compared with 2008 figures, 6,760 vs. 14,800.

Barrot Calls for Sharing of Asylum Burden and Single Asylum Procedure (News)

Jacques Barrot, EC Vice President for Justice, Freedom and Security, in an opinion piece about migrants and refugees written for the Times of Malta warned of risks that must be avoided, including the “risk … of believing that migratory flows and the right to asylum can be dealt with mainly at national level, without the need for very close coordination within Europe. Such fragmentation of migratory policies is an absurdity within the borderless Schengen area.”

Barrot said that he will soon be making “a large number of legislative proposals” to build upon the European Pact on Immigration and Asylum.  Barrot said that asylum seekers must be covered by a single procedure regardless of where the application is made and there need to be “solidarity between member states, to take the pressure off certain countries that are being overwhelmed by migration because of their geographical position.”

Barrot called for the Dublin Regulation to be amended so that asylum applications may be pursued in a member state other than the state of first arrival: “there is a vital need to think about how to set up a voluntary programme for the balanced distribution of refugees within Europe.”

Barrot also called for an international conference to be held in Libya during the Libyan Presidency of the African Union to discuss closer cooperation with countries bordering the Mediterranean “so as to effectively combat people traffickers and establish arrangements for the reception and protection of asylum-seekers which meet international standards.”

Greece Says Situation in Eastern Aegean is Out of Control (News)

Greek Deputy Foreign Minister Valinakis met with European Commission Vice President Barrot and asked for urgent assistance in regard to situation in the Eastern Aegean, saying that illegal migration has “spiraled our of control.”

The Dep. FM asked for immediate assistance to include:

“ intensifying and strengthening joint operations and patrols under FRONTEX along our “sea borders, with more European resources (maritime, air, specialised experts).

“ further financial support for tackling emergencies.

“ implementing immediate and practical measures that would relieve insular areas from the pressure such as using a ship of sufficient tonnage as a first reception and transport centre for illegal migrants.”

The Deputy FM indicated that Greece has raised these proposals in Stockholm with the new Swedish EU Presidency and would seek to raise these at the European Summit in October.

IOM: Lisbon Treaty Will Help Migration Issues (News)

“New Europe” interview with Bernd Hemingway, Director of the Brussels office for the International Organisation for Migration.  Excerpts:

“What is your opinion of the European Union’s migration policy at the moment?

-We are receiving a lot of support, in particular from the European commission, but given the diversity of the substance we find ourselves very often kind of in a deadlock between bureaucracies of a different directors general, who are responsible for dealing with a different aspects of climate change, migration, adaptation policy, humanitarian assistance, environment, energy, so it is very very difficult to find an entry point and somebody who wants to have a look at this from this holistic approach that you really need to address it.

“How would you judge the differences of migration policies across the European Union?

-Where I see the EU heading, very much depends on the vote of the Irish people. Because if we will have the Lisbon Treaty, it will be a lot easy to have an integrated migration policy inside the EU and I think that is where the EU is basically heading at, because migration management is part of the first pillar.”

ECRE Memo to Swedish EU Presidency re Asylum Policies (Statements)

On the eve of Sweden’s assumption of the EU presidency, ECRE has sent a memorandum to the Swedish Government relating to EU asylum policies and the Stockholm Programme, scheduled to be finalized in late 2009 towards the end of the six month EU presidency.

Excerpts from the ECRE memo:

“… ECRE urges Sweden to take a rights-respecting approach during its Presidency and to seek to uphold Europe’s longstanding human rights tradition, and to play a leading role in promoting fair and humane European policies towards asylum seekers and refugees.

“In recent years the EU has increasingly focused on measures aimed at preventing and combating irregular entry. Many of these border control measures lack the necessary mechanisms to identify individuals in need of protection and allow their access to the territory and subsequently to an asylum procedure. This is leading to the violation of the principle of non-refoulement at Europe’s borders and is having a major impact in preventing refugees from seeking asylum in Europe.

“States have also developed a range of externalised migration controls beyond their borders, which allow people to be returned before they can ever reach European territory.

“ECRE stresses that Member States’ obligations under international and European refugee and human rights law do not stop at the physical boundaries of the EU. Member States cannot abdicate their principles, values and legal commitments by doing outside their borders what would not be permissible in their territories.

“The obligation of non-refoulement does not arise only when a refugee is within or at the borders of a state, but also when a refugee is under its effective or de facto control, including in international waters or those of another state. ECRE is therefore seriously concerned by the situation in the Mediterranean, especially reported pushbacks of possible refugees to third countries such as Libya.

“ECRE is also deeply worried about any proposals envisaging the setting up of external processing which would allow EU States to evade their obligations to protect refugees by shifting the responsibility to third countries with extremely dubious human rights records. While building protection capacity in third countries is a welcome objective, such cooperation must be additional to, and not a substitute for facilitating access to protection within the EU.

“EU states also need to place greater emphasis on developing protection-sensitive border controls, including through FRONTEX, the EU external border management agency. Oversight of FRONTEX activities should be strengthened through increased supervision of its activities, including consultation with and reporting back to the European Parliament concerning the agency’s work programme and activities. FRONTEX should also engage in a structured cooperation with asylum experts such as the United Nations High Commissioner for Refugees (UNHCR) and non-governmental organizations  (NGOs) with relevant expertise, in order to facilitate operations that take account of protection issues.”

Swedish PM Expresses Doubts Over “Burden Sharing” Plan (News)

In a press conference with the Maltese PM, Swedish PM Fredrik Reinfeldt said

‘I know that Malta is pushing for more burden sharing to solve its immigration problems and that the Commission is also pressing on this point but, as you know, there are different views among member states on this. We will do our part and push a bit more. We do recognise that burden sharing can be a way forward. However, we also need to ensure that migrants are also welcomed in Europe. So, although burden sharing is important, there are difficulties and it is easier said than done.’

Maltese PM Lawrence Gonzi said that

‘Malta wants concrete help and we recognise the suggestions put forward by the European Commission and endorsed last week by EU leaders that the new Stockholm programme in the field of justice and home affairs will also include concrete measures on burden sharing among member states.’

According to the Times of Malta, “[i]n EU circles, Sweden is considered to be among the most sceptical member states when it comes to asylum and migration policy and, lately, was among the leading group of Nordic member states trying to water down the Commission’s initiatives to help Malta and other southern EU members facing major influxes of immigrants from sub-Saharan Africa.”

Swedish and Maltese PMs Meet to Discuss Stockholm Plan (News)

Maltese PM Lawrence Gonzi is meeting with Swedish PM Fredrik Reinfeldt in Sweden in advance of Sweden’s 1st July assumption of the EU presidency.  Irregular immigration and the Stockholm programme, the new 5 year plan for EC Justice and Home Affairs replacing the Hague Programme, are being discussed.

Maltese Patrol Boats Funded by EU External Borders Fund (News)

blog - Austal shipFour new patrol boats for the Armed Forces of Malta are scheduled to be delivered in six months.  The boats cost €9.6 million.  75% of the cost is coming from the EU External Borders Fund.
