MaltaToday: Italy withholding data on Mediterranean rescue operations from Frontex

An article from yesterday in MaltaToday by Jurgen Balzan reports that Italian authorities are not sharing information with Frontex regarding the number of migrants and asylum seekers rescued at sea in the Central Mediterranean and suggests that the withholding of information may be related to an effort to minimize public concerns over migration as Italy nears a vote next month on a constitutional referendum supported by PM Renzi.

From the article: “…Italian authorities are not sharing the data [regarding rescued migrants] with Frontex … and are keeping the number of people rescued under wraps. A Frontex spokesperson told MaltaToday that although the agency is actively participating in the rescue operations, the Italian authorities ‘are not sharing’ the data on how many people were rescued or how many people lost their lives last week.  Sources close to the Armed Forces of Malta said that Frontex normally holds and provides such data and ‘if they don’t have the numbers then information is being withheld by the Italians.’…”

WikiLeaks Releases Restricted Document: EUNAVFOR MED Operation SOPHIA Six Monthly Report

WikiLeaks yesterday released the ‘EUNAVFOR MED Op SOPHIA – Six Monthly Report’. (Also available here: EEAS-2016-126.) The 22 page document is classified as EU RESTRICTED and provides a detailed description of EUNAVFOR MED’s operations during the period 22 June-31 December 2015 and discusses the next steps for the operation, including the move to Phase 2B which would entail operations within Libyan territorial waters. The operation currently operates outside of Libyan territorial waters consistent with UN Security Council Resolution 2259 (2015). The report is signed by Rear Admiral Enrico CREDENDINO, EUNAVFOR MED Op SOPHIA Operation Commander.

Here are some selected excerpts from the report:

Smugglers’ Business Model –

…Wooden boats are mainly used for migrant smuggling to the west of Tripoli, and rubber boats are more common to the east of Tripoli. Wooden boats are more valuable than rubber dinghies because they can carry more people, hence more profit for smugglers and are more resilient to bad weather and can be re-used if recovered by smugglers. However, following operation SOPHIA entering into Phase 2A (High Seas), smugglers can no longer recover smuggling vessels on the High seas, effectively rendering them a less economic option for the smuggling business and thereby hampering it.

Inflatable boats are used in two thirds of the cases and wooden boats in one third of the cases. According to intelligence sources, the wooden boats used are purchased from Libyan fishermen or imported from Tunisia and Egypt. EUNAVFOR MED are monitoring, within capabilities, the supply routes for these, but no detection has been obtained to confirm beyond any reasonable doubt this supply method.

Reports of rubber boast being imported from China and transhipped in Malta and Turkey are supported by a recent interception by Maltese customs of 20 packaged rubber boats in a container destined for Misratah, Libya. As there are no legal grounds for holding such shipments, it was released for delivery to the destination….

Legal Basis for Phase 2A – High Seas –

…The legal basis applicable to phase 2A (High Seas) relies on the international law applicable to the Operation (UN Convention on the Law of the Sea, Palermo protocol against the smuggling of migrants by land and sea) and on individual Member States’ application of the EU mandate through domestic legislation to board, seize and divert vessels and to detain suspected smugglers and traffickers. The adoption of UNSCR 2240 (2015) by the UN Security Council on 9 October, reinforces the legal framework applicable to EUNAVFOR MED activities in international waters. The resolution now provides the legal basis for all Member States to undertake these activities against suspected smugglers and traffickers coming from Libya….

Cooperation with International Organisations –

…In particular we have embedded the training initially provided by UNHCR on migrant handling and international law and this is now a core part of the inchop [command zone] package for new units joining the operation. We are further building on this training with input from UNICEF….

Campaign Assessment –

…Entry into Libyan Territorial Waters will undoubtedly allow us to achieve further success as we get towards the heart of [smuggler and trafficker] networks….

…From a military perspective, EUNAVFOR MED is ready to proceed to Phase 2B (Territorial Waters), though the political and legal challenges ahead remain a significant challenge….

…Transition from phase 2A to 2B [Libyan Territorial Waters] will require for a number of significant challenges to be resolved before I can actually recommend the transition.

Next Steps and Key Challenges-

From a military perspective, and to be more effective against the smugglers’ business model, I need to move to phase 2B (Territorial Waters) as soon as possible. However there are a number of key issues that need to be addressed. These are:

The Legal Finish.

As we will be operating in Libyan Territorial Waters, the current legal finish, of prosecuting suspected smugglers in Italy will not apply. We will therefore need a new legal basis; either an agreement with the Libyan authorities that they will waive their right to prosecute suspected smugglers in Libya and allow them to be prosecuted by another Member State, or to have a transfer agreement in place for apprehended smugglers to be transferred to the Libyan authorities for prosecution. Both options have specific challenges end rely on the consent of the Libyan authorities. If we were to transfer suspected persons to the Libyan authorities, we would need to ensure that they are treated in accordance with human rights standards that are acceptable to the EU and Member States….

…Regardless of the challenges with both options, we are working very closely with the EEAS to come to a workable solution. It is however clear that regardless of the solution taken, the Libyan authorities are fundamental in making this happen, either by providing the agreement to prosecute in another country, or to agree to prosecute in Libya through a judicial system which meets those standards required by the EU. I want to underline the fact that this issue must be solved before we can move to phase 2 Bravo. Without the required legal finish we will be compelled to release suspected smugglers apprehended in Libyan Territorial Waters, with a subsequent loss of credibility for the operation in the media and EU public opinion.

Legal mandate – UNSCR and Libyan Invitation.

In order to move to phase 2 in Libyan territorial waters, we need firstly an invitation from the GNA, as the sole legitimate Government of Libya under UNSCR 2259(2015), and secondly a UN Security Council Resolution to provide the necessary legal mandate to operate. Whilst the transition to phase 2 in Libyan TTW with only a UNSCR without an invitation from the Libyan authorities is theoretically possible, it is unlikely that the UNSCR would be adopted as Russia and China have previously stated that a Libyan invitation would be required by them so as not to block the resolution….

Capacity and Capability Building –

As we move into Territorial Waters, our interaction with the Libyan Navy and Coastguard will increase and we will need to gain confidence in their activities. The capability and capacity of the Libyan Coastguard to protect their borders needs to be developed and therefore preventing illegal migration from Libyan shores, so that we can reach the end state of the mission where illegal migration is at a manageable level without the need for EUNAVFOR Med. This will have to be shaped with Libyan authorities to match their expectations and could benefit from cooperation with other EU missions….

UN Security Council Likely to Consider Resolution Authorising EU Action Against Migrant Vessels

AP is reporting that the Russian UN Ambassador has said that “the United Nations Security Council is discussing a draft resolution to address Europe’s migrant crisis, likely by authorizing the inspection of suspected migrant ships [in international waters and not in Libyan territorial waters].” A resolution may be adopted this month.

UK and France to Seek UN Security Council Authorisation for Military Action Against Smuggler Boats

From Malta Today: “The United Kingdom and France, members of the United Nations Security Council, will kick off discussions in an attempt to obtain a UN resolution mandating the destruction of boats used by smugglers.”

From AFP: “Italian Prime Minister Matteo Renzi added that leaders from France and Britain, both permanent members of the UN Security Council, had ‘committed to get a resolution from the United Nations for an intervention in Libya.’”

Earlier today the Security Council released a short Presidential Statement regarding the “The Impact of the Humanitarian Crisis in Syria on the Neighbouring Countries.” Here are some excerpts from the PRST with bearing on the migrant and refugee flows in the region:

“[***] The Security Council expresses grave alarm at the significant and rapid deterioration of the humanitarian situation in Syria, including at the fact that over 220,000 people have been killed, including well over 10,000 children since the beginning of the conflict ; around half of the population has been forced to flee their homes, including over 3.9 million who have sought refuge in neighbouring countries, among which are nearly 2.1 million children ; and that more than 12.2 million people in Syria require urgent humanitarian assistance including 440,000 civilians in besieged areas.[***]

The Security Council is alarmed that the Syrian crisis has become the largest humanitarian emergency crisis in the world today, threatening peace and security in the region with diverse implications on the neighbouring countries and the displacement of millions of Syrians into those countries, and calls to address further spill-over of the conflict in Syria into the neighbouring countries. [***]

The Security Council underlines the risk of further regional destabilization if the conflict, refugee crisis and the needs of the host countries are not adequately addressed. The Security Council stresses the importance of funding the humanitarian and development responses to the refugee crisis, providing support for national response plans, addressing the humanitarian needs of refugees, in particular women and children, both in camps and urban areas and through capacity building and technical support, strengthening the resilience of host countries and communities as components of stabilizing the region, preventing radicalization and countering the threat of terrorism and foreign terrorist fighters.

The Security Council notes with concern that the international response to the Syrian and regional crisis continues to fall short of meeting the needs as assessed by host governments and the United Nations, and urges all Member States, based on burden-sharing principles, to support the United Nations and the countries of the region, including by adopting medium and long-term responses to alleviate the impact on communities, providing increased, flexible and multi-year predictable funding as well as increasing resettlement efforts, and taking note in this regard of the Berlin Communiqué of 28 October 2014. [***]”

“The members of the Security Council deplored the recent maritime tragedy in the Mediterranean Sea that resulted in hundreds of casualties, and extended their deepest condolences to all those affected and to their families.

The members of the Security Council expressed their grave concern at the recent proliferation of, and endangerment of lives by, the smuggling of migrants in the Mediterranean Sea, off the coast of Libya.

The members of the Security Council expressed their concern at the implications for regional stability posed by transnational organized crime and illicit activities such as the smuggling of migrants, condemned and deplored the said acts and underlined the need to bring the perpetrators of these acts to justice.

The members of the Security Council called for the full implementation by State Parties of the Protocol against the Smuggling of Migrants by Land, Sea and Air, supplementing the United Nations Convention against Transnational Organized Crime.

The members of the Security Council expressed their strong support to countries in the region affected by the smuggling of migrants and emphasized the need to step up coordination of international efforts in order to strengthen a global response to this common challenge, and in order to protect these vulnerable migrants from being victimized by human traffickers.

The members of the Security Council urged all Member States, including countries of origin and transit, to cooperate with each other and with relevant international and regional organizations, including the IOM [International Organization for Migration], in addressing illicit migration flows, and dismantling smuggling networks in the region.

In that regard, the members of the Security Council urged all States to comply with their applicable obligations under international law, including international human rights law, international humanitarian law, and refugee law.”

Very Few Migrants Reaching Italy Apply for Asylum

While roughly 170,000 migrants over the past 14 months have reached Italy or been rescued and brought to Italy, according to UNHCR and Eurostat figures, very few of them are applying for asylum in Italy. Eurostat data through November 2014 indicate approximately 25,200 asylum applications from all nationalities were filed in Italy during the first six months of 2014; the number increased to approximately 27,000 during the period July-November 2014.

Eurostat data further show that only 455 asylum applications were submitted by Syrians in Italy during the January-November 2014 period, whereas over the same period over 28,000 Syrian asylum applications were submitted in Germany.

According to Italian press reports, “[n]ew figures from the UN’s refugee agency showed 25,077 people applied for asylum in Italy during the first six months of 2014. The highest number in Europe was recorded in Germany, which received 77,109 applications, followed by France (54,131) and Sweden (38,792).”

IOM Report on Recent Use of Cargo Ships to Transport Syrians to Italy

Excerpts from a short IOM report released on 6 January 2015 on the recent use of cargo ships, specifically the Blue Sky M and the Ezadeen, to transport Syrians towards Italy:

“IOM analysts do believe the prospect of single-nationality cargoes – on these latest voyages, migrants fleeing Syria – creates opportunities for smuggling rings to employ certain economies of scale that were not apparent in the more ‘mixed’ passenger manifests seen leaving Egypt and Libya in 2014.”

“‘The predictability of thousands now fleeing Syria every month allows smugglers to plan for a reliable stream of customers, which of course allows them to set a price point,’ explained Joel Millman, a spokesperson for IOM in Geneva. ‘So they can predict how much revenue each trip will bring, and then quickly deploy vessels and crews’. Millman added that Lebanon’s recent decision to require visas of Syrian migrants seeking to enter Lebanon may divert new migrant traffic to Turkey’s coasts, which will swell demand for smugglers’ services.”

“In the last four months of 2014 IOM learned of larger ‘mother’ ships waiting in open water to receive passengers ferried out by smugglers. Larger ships leaving Turkey loaded with migrants from Syria began appearing in greater numbers late last year in the Eastern Mediterranean.”

“Maritime experts calculate that such ships normally would be available for between USD 100,000 and USD 150,000, allowing smugglers to earn upwards of USD 3 million for voyages like the two that ended in recent days, with up to 900 migrants crammed on board.”

“‘This new route is a direct consequence of the Syrian crisis,’ added IOM’s [Federico] Soda. ‘Despite the end of the Mare Nostrum’s rescue-at-sea operations, arrivals continue because of the many crises close to Europe.’”

Turkish Coast Guard Reports Intercepting 12,872 Migrants in Aegean Sea in 2014; Some Migrants Pushed-Back into Turkish Territorial Waters

“A total of 12,872 migrants trying to cross into Greece from Turkey over the Aegean Sea were captured by Turkish Coast Guard Command teams in 524 separate incidents in 2014, while 74 people were also arrested on charges of smuggling migrants, Anadolu Agency has reported. The number of migrants who were captured in 2013 was 8,047, including 6,937 on the Aegean Sea. The total number of migrants captured by authorities across Turkey in 2012 was 2,531. The official number in 2011 was 546, which means that the number of captured migrants has increased 24-fold since then. …”

An unspecified number of the intercepted migrants were reportedly subjected to push-back practices where the affected migrants were returned to Turkish territorial waters [“Yasa dışı göçmenlerin bir kısmı da ‘geri atma olayı (gittiği ülkeden Türkiye karasularına geri gönderilme)’ olarak arz edilen olaylar sonucu yakalandı.”].

The push-backs were presumably carried out by Greek patrol boats or possibly by vessels operating pursuant to Frontex Joint Operation Poseidon Sea 2013 (which operated through 2014 Q1).

Frontex: Preliminary Figures Indicate 270,000 Irregular Migrants and Asylum Seekers Reached EU in 2104 – Double Previous Record Set in 2011

In an interview with EFE, “Frontex Deputy Executive Director Gil Arias Fernandez said the numbers for 2014 nearly doubled the previous record of 141,000 that was registered in 2011 and attributed to spillovers from the Arab Spring. … [Arias Fernandez] noted that the number of immigrants fleeing their countries seeking international protection has increased. ‘A few years ago, immigration for economic reasons was estimated at 50 percent and the same percentage for political refugees, while in 2014 about 80 percent of immigrants to the EU will be asylum seekers,’ he said. Although Frontex will not reveal specific details until mid-January 2014, [Arias Fernandez] said the total figure will likely exceed 270,000 people, as about 260,000 migrants were recorded till November….”

Frontex Update on Incident Involving Ezadeen Cargo Vessel

Frontex press statement: The cargo vessel was carrying 360 migrants and had departed from Turkey. “People smugglers began using cargo vessels like Ezadeen last summer, and it has now become a new method of bringing migrants to Europe. These decommissioned freighters, up to 75-metre long, depart from Turkey and head for the Italian cost. Some 15 incidents involving cargo ships have taken place since August 2014.”

Frontex: Update on Operation Triton; Growing Use of Larger Vessels by Smugglers

Frontex last week released updated information on Operation Triton since its launch on 1 November. Frontex also reported on the growing use by smugglers of older freighters and cargo vessels which are being obtained primarily in south-eastern Turkey and which are being used by smugglers to transport larger numbers of migrants – as occurred yesterday with the rescue of 500-700 migrants on board the Moldovan flagged Blue Sky M between Greece and Italy.

Excerpts from the Frontex statement:

“Since the launch on November 1st of Operation Triton, the Frontex-coordinated mission in the central Mediterranean, some 11,400 migrants have been rescued, about 10,000 of them in situations characterised as “distressed,” in 77 separate Search and Rescue incidents at sea. Although significantly smaller than the number recorded during the August peak – when some 28,000 migrants were detected on this route – this level of traffic is still unprecedented for wintertime….”

“In a rapid adaptation of strategy that has become their hallmark, the smugglers have started using much larger boats. These are typically decommissioned freighters, up to 75m long, procured in the ports of south-eastern Turkey, notably Mersin: a departure point still connected by ferry to the Syrian port of Latakia, making it reachable for the tens of thousands of Syrians still fleeing the conflict in their country. The freighters, repaired and manned by crews sometimes hired from as far away as Russia, are piloted via Cyprus and Crete towards Italy, which remains the EU destination of choice for refugees from the Middle East.”

[Editor’s note: yesterday’s incident involving the rescue by Italian authorities of the Moldovan cargo ship Blue Sky M carrying hundreds of migrants would seem to be one such example; AIS tracking information from Marine Traffic shows that the Blue Sky M spent approximately five days (20-25 December) sailing in circles off the south-eastern Turkish coast before it began sailing towards western Greece. “A place on a freighter from Turkey costs at least three times the price of a ticket on the usual sea route from Libya. And yet the migrants are willing to pay. Travelling this way not only circumvents the considerable danger of capsizing in a small boat in rough seas: it also avoids having to go to Libya. The departure point of choice for facilitator networks in 2014, this increasingly lawless North African nation appears to have become too dangerous an operating environment even for the criminal gangs….”

“For all its advantages, though, the new route from Turkey is not without dangers. The engines of the old ships are often highly unreliable. In the last six weeks alone, one freighter has been found drifting near Cyprus; another was rescued 30 miles off Crete; still others, off the Italian coast. The danger of shipwreck is greatly increased by the smugglers’ habit of switching off the freighter’s AIS (the Automatic Identification System with which all boats over 300 tonnes, as well as all passenger ships, are equipped). The effect is to make the boat electronically invisible to the Italian search and rescue authorities – a stratagem that buys time for the smuggling crew to escape by fast launch and thus avoid arrest.”

“Frontex has discerned another worrying recent trend: some 30% of all migrants rescued at sea in September and October were picked up by civilian shipping – the vast majority of them, 52 incidents, off the coast of Libya. The smugglers have learned to time the departure of migrant boats so that they cross the paths of merchant ships heading for the EU. When a distress call is transmitted, the merchant ship, being the nearest, is obliged by international maritime law to go to the rescue – and then disembarks them at the next port of call.”
