EU Fundamental Rights Agency Transmits Opinion on Stockholm Programme (Statements)

The European Union Agency for Fundamental Rights (“FRA”) presented its opinion regarding the Stockholm Programme as proposed by the European Commission at the beginning of June 2009.

Relevant portions include the following:

“Secure that access to EU territory is dealt with under the rule of law:

Absolute respect for fundamental rights and international protection must accompany any measure of border surveillance and control. Fundamental rights safeguards contained in the Schengen Borders Code, such as respect for the principles of non-refoulement, non-discrimination and the duty to fully respect human dignity must be upheld in practice.”

“Measures to control access to the territory of Member States increasingly take place before third country nationals reach the territory of the European Union; … It should be recalled that according to international law and, more specifically, Article 1 ECHR, State responsibility deriving from human rights obligations may be engaged outside the national territory of the State concerned.”

“Therefore, the EU and its Member States have to dedicate attention as to what effects the extra-territorialisation of its immigration policies has on potential immigrants and their rights as human beings. This is in particular the case for potential mechanisms to process asylum applications outside the European Union. Such mechanisms should be guided by the rule of law principles. They should be set up in a manner that does not limit access to fair and efficient procedures in Member States for those who will continue to arrive in Europe spontaneously.”

“Particularly acute is the situation at sea, where the lives of thousands of people remain at risk. Border control and surveillance measures have to be designed with the necessary safeguards to ensure full respect of fundamental rights as well as search and rescue obligations deriving from international maritime law.”

“The principle of non-refoulement remains applicable on the high seas, thus barring the direct or indirect return of individuals to countries where they are at risk of persecution, torture, inhuman or degrading treatment or punishment.  Operational tools, such as the guidelines for FRONTEX operations at sea proposed by the Commission early this year, should be adopted quickly with a view to providing practical guidance on how to act in full respect of fundamental rights. EC Commissioner: New Policies Needed for Mediterranean to “Head Off This Great Tide of People” (News)

Joe Borg, Commissioner for Maritime Activities and Fisheries, said that the time has come to act on new policies between Europe and North Africa.  Borg said a new strategy is needed to find mechanisms more suited ”to involving cooperation with third-party states of the basin. If we do not achieve this objective, we will be left with a somewhat unbalanced system of management for the Mediterranean”.

If a joint system between Europe and third countries is developed, assessment of sensitive issues such as illegal immigration ”could be coordinated with other aspects of the problem, such as developing systems of surveillance in North African countries, using development funds to head off this great tide of people”.

ANSAmed: “A pilot project is also on the cards for improving cooperation between national authorities of member states involved in surveillance operations as well as information exchange between port authorities. A study will then be launched to plan European maritime space and to realise an integrated project in connection with the EU’s Era-Net research network for strengthening coordination in marine research. All of which, Borg notes, must not disregard significant implements which are already in place: from the Mediterranean Union to Europe’s neighbourhood policies. The ball is now in the court of the EU’s general Council of Ministers and the Euro-parliament in the hope that it be taken up at December’s European summit.”

1300+ Haitian Migrants Interdicted to Date in 2009 (News, Data)

164 Haitian migrants were interdicted and returned to Haiti by the US Coast Guard earlier this week.  1,374 Haitians have been stopped and returned to Haiti by US authorities to date in 2009.

“The summer has been largely silent in terms of repatriation but dozens were caught and sent packing in the first quarter of the year. January was especially a busy month, with 621 Haitians sent back in the first month of 2009.”

Call for Applications for Study on Migration and Asylum in the Maghreb (Communiqués)

“The Euro-Mediterranean Network of Human Rights (EMHRN) wishes to launch a study on migration and asylum in the Maghreb countries. This study will be based on literature reviews and field studies to be undertaken in close cooperation with EMHRN’s member organizations working in the fields of human rights, migration and asylum.”

“The study should mainly analyze the legal and administrative framework applicable to migrants, refugees and asylum seekers (MRAS) in the Maghreb countries (Morocco, Algeria, Tunisia and Libya), with a particular interest on the impact of this framework on the protection of their rights. The research should, among other things, identify the main deficiencies (de jure and de facto) in terms of protecting the rights of the MRAS.”

The deadline for applications is 28 September 2009.

EC Call for Grant Proposals Relating to Mediterranean Migration Cooperation (Communiqués)

“The European Commission has issued a Call for Proposals providing €31 million for migration and asylum cooperation along Mediterranean migratory routes, covering partners in the ENPI South. (EuropeAid/128764/C/ACT/Multi)”

“The general objective of the thematic programme is to help third countries better manage all aspects of migratory flows in all their dimensions.”

“The programme … is designed in particular to:

  • foster the links between migration and development;
  • promote well-managed labour migration;
  • fight illegal immigration and facilitate the readmission of illegal immigrants;
  • protect migrants’ rights, protect them against exploitation and exclusion, and support the fight against trafficking in human beings;
  • promote asylum and international protection of refugees.”

“[T]wo of the programme’s six lots specifically involve Mediterranean Partner Countries.”

“Lot 1: Southern migratory routes (sub-Saharan Africa and the southern Mediterranean) has an indicative allocation of funds of €28.5 million, €14 million for 2009, and €14.5 million for 2010, subject to adoption of the 2010 budget.”

“The lot is broken down into five sub-lots as follows:

  • Sub-lot A (€10.5 million): Western African Route, including Maghreb, ECOWAS, CEMAC region and Democratic Republic of Congo (DRC)
  • Sub-lot B (€9.5 million) Eastern African Route, including Libya, Egypt, Sudan, Horn of Africa, Yemen, Great Lakes Region
  • Sub-lot C (€5 million) Northern Africa region, in line with Albufeira conclusions
  • Sub-lot D (€2 million) Southern Africa region
  • Sub-lot E (€1.5 million) Promoting the contribution of the Diaspora to act in Africa as a development actor for this continent through the establishment of an African Diaspora platform for development”

“Grants requested for an action under the Call for Proposals must fall between €500,000 and €2 million. The planned total duration of an action may not be lower than 12 months nor exceed 36.”

“The deadline for submission of Concept Notes is 13 November 2009.”

More Migrants Shot Dead at Egypt-Israel Border (News)

Egyptian police shot and killed four African migrants and wounded two others near the Egypt-Israel border.

“Monthly migrant arrests by Egypt at the border have surged this year, rising five-fold in May to 55 and then doubling again to 114 in June and 160 in July, security sources said. That compares to just six arrests in January.”

The increased numbers of migrants attempting to enter Israel from Egypt is believed to be related in part to the Italy-Libya agreement which has resulted in the forcible returns of hundreds of migrants who are interdicted in the Mediterranean.

68 Migrants Arrive in Canary Islands (News)

A cayuco boat with 68 migrants believed to be from Gambia arrived in the Canary Island in the port of Los Abrigos.  The migrants were detained.

Frontex Helicopter Warned by Turks (News)

The Turkish military warned a Latvian helicopter on a Frontex mission near the Greek island of Farmakonissi in the Aegean Sea to leave the area.  Turkish authorities presumably believed that the helicopter had entered Turkish airspace.

Berlusconi Angered Over Comments by EC Spokesman (News)

Prime Minister Berlusconi has threatened to take steps to block the work of the European Council of Ministers unless measures are implemented to prevent European commissioners and their spokespersons from speaking publicly on any subject.  Berlusconi is angered over the remarks made by Commission spokesman Dennis Abbott regarding the Somali migrants recently returned to Libya by Italy.

“Berlusconi said ‘We shall no longer vote, blocking in effect the workings of the European council [of ministers], unless it is decided that no European commissioner and no spokesperson may intervene publicly on any subject.’”

Italians Ignore Intercepted Migrants’ Requests for Asylum (News)

The group of 75 migrants used a satellite telephone to seek assistance while they were being returned to Libya by Italian authorities.  Several of the migrants telephoned a BBC reporter in Italy from the Italian patrol boat which had intercepted their dinghy.

One caller told the reporter ”we told the Italian military that we wanted to request asylum and asked them not to hand us over to the Libyans because we were afraid of going to jail, but they wouldn’t listen to us.”

Some of the migrants protested and refused to be moved from the Italian patrol boat to a Libyan patrol boat.  The Italian boat was forced to dock at the Libyan port of Al Zuwarah in order to off load the migrants.

“A spokesman for the European Commission, Dennis Abbott, said the EU executive would ask the Italian government for details regarding Monday’s expulsion. But Abbot clarified that the EC was not ‘pointing its finger’. The spokesman explained that the EC’s goal was rather ‘to protect the right of every human being to request refugee status’ by enlisting the cooperation of member countries to share in the burden of hosting them.”

Italy Forcibly Returns 75 Migrants to Libya; 1,000 Migrants Forcibly Returned Since May (News)

A boat carrying 75 migrants who are believed to be Somali was intercepted by Italian authorities near Sicily and its occupants were subsequently forcibly returned to Libya.  This occurred while Italian Prime Minister Silvio Berlusconi was in Libya to meet with Libyan leader Moamer Gathafi during Libya’s celebrations of the 40th anniversary of their revolution.

Prior to the Italian interception of the migrant boat, an Armed Forces of Malta patrol boat removed four migrants and brought them to Malta for medical treatment.  The migrant boat was initially discovered by a Frontex helicopter.

80 New Migrant Arrivals in Malta (News)

80 migrants have arrived in Malta in 2 boats.  One boat landed on shore before being detected and the second was intercepted just off shore.  At least one body was recovered from the water.

The Armed Forces of Malta released a photo of one of the migrant boats for the purpose of contrasting its condition with the dinghy used by the five Eritreans who were rescued last week by the Italians.  The AFM has questioned whether the Eritrean dinghy from last week carried a large number of other migrants, as the survivors have reported.

92% Reduction in Irregular Migrant Arrivals in Italy (News, Data/Stats)

Italian Minister of the Interior, Roberto Maroni, claims a 92% reduction in the arrivals of irregular migrants since 5 May when the new Italian policy of turning migrants back to Libya was put in place.

Since 5 May there have been 1,345 migrant arrivals in Italy compared with 14,220 over the same period in 2008.

“Repulsion” works:   “This means that our accord with Libya is working excellently: it works, and the results are there to be seen”. “Repulsion, is the same as saying taking the irregular migrants back to their place of departure. Repatriation means sending them back to their countries of origin, with all the bureaucracy that involves,” said Maroni.

Armed Forces of Malta Releases Photo of Eritrean Dinghy (News)

“The photo was taken from the FRONTEX-operated Casa-212 Aviocar patrol and surveillance aircraft.”

“‘This declassified image shows clearly the excellent and clean state that the intercepted rubber dinghy was in, as well as the good state of health of the occupants, who can be seen sitting down,’ the AFM said.”

57 New Migrants Rescued Near Lampedusa (News)

Maltese and Italian news services report that a new dinghy with 57 African migrants on board has been rescued near Lampedusa and that the individuals are being transported to Sicily.

There is renewed controversy between Italy and Malta because a Maltese patrol boat may have again provided some assistance to the migrants prior to their arrival in Italian waters.
