Turkey Considers Use of “Safe Havens” Within Syrian Territory If Faced With Massive Influx of Asylum Seekers

Turkey is reportedly preparing contingency plans for a possible worsening of conditions within Syria and an influx of Syrian refugees.  According to the Hurriyet Daily News, Turkey wants to avoid a repeat of the situation it faced when hundreds of thousands of Iraqis fled Iraq for Turkey in the 1990s.  250 Syrians crossed into Turkey last Friday and are seeking asylum.

“Turkey is considering establishing safe havens on the Syrian side of the border to cope with a potential massive influx of refugees from the unrest-hit neighboring country, the Hürriyet Daily News & Economic Review has learned. … This plan envisions the establishment of some safe havens on the Syrian side of the border whose security and humanitarian needs would be provided by Turkey. This would keep Turkey from permanently hosting tens of thousands of people who could return to their homes after the tension in Syria is defused. … As a sovereign state, Syria would likely oppose the idea of forming such safe havens, which would be protected by Turkish troops, within its territory. ‘Unless the United Nations Security Council demands such interventions, this move could be interpreted as an attempt at occupation,’ an expert on international migration told the Daily News on Sunday….”

Cyprus, Greece, Italy, Malta, & Spain Issue Joint Communiqué Regarding Response to North African Migration

Ministers of Home Affairs and Internal Security from Cyprus, Greece, Italy, Malta, and Spain, met in Nicosia on 19 April and issued a Joint Communiqué.  Here is the full text (HT to EASO Monitor):

“Joint Communiqué II

(Nicosia, 19 April, 2011)

Following the meeting in Rome on the 23rd February 2011, the Home Affairs and Internal Security Ministers of Cyprus, Greece, Italy and Malta as well as the representative of the Minister of Interior of Spain, met again today in Nicosia and discussed the continuing dramatic developments in the Southern Mediterranean region. At the end of the meeting it was decided to issue the following Joint Communiqué.

The Home Affairs and Internal Security Ministers of the Mediterranean Member States of the EU:

Recalling our February 23rd,2011 Joint Communiqué, we have repeated our utmost concern for the unfolding events in relation to the humanitarian situation as well as to the massive illegal immigration flows and movements of possible beneficiaries of international protection that affect our countries;

Taking into account that the escalating events in countries of Northern Africa and the greater Middle East are destabilising the region and acknowledging that political reforms and democratic transitions will not take effect immediately and that their outcome is still uncertain;

Bearing in mind Europe’s longstanding tradition and commitment to the provision of international protection to people in need, in accordance with the Geneva Convention and in line with humanitarian principles and full respect of human rights;

Underlying that security and stability in the Mediterranean is directly linked to the security and stability of the EU as a whole and that effective response to this challenge requires joint efforts, commitment and solidarity from all EU Member States;

Stressing that the current emergency situation with regard to the massive illegal immigration flows and movements of possible beneficiaries of international protection brings upon the Mediterranean Member States additional social, economic, administrative and demographic burden, to that already prevailing;

Recalling the already existing intense and continuous migratory pressure at the south eastern external borders of the EU;

Expressing deep concern about the conflict in Libya and its consequences in terms of sufferings of countless human beings and growing number of displaced persons fleeing the war and taking into account that huge number of people in need of international protection could arrive at the most exposed Mediterranean Member States in the immediate future;

Emphasizing that the possible prolongation of such influxes of illegal migrants and asylum seekers to the Mediterranean Member States, cannot be managed without the concrete and substantial support and solidarity from the rest of the EU’s Member States; alternatively, the situation will seriously jeopardize our ability, and subsequently the Union’s ability, to manage the displaced persons and provide those in need with international protection as well as undermine our common security;

Stressing that the arising situation will challenge and undermine the efforts of those Member States to reform their overburdened national asylum systems;

Reaffirming the urgent necessity for EU to provide concrete and immediate support to Member States on the EU southern external borders;

Stressing the need for additional actions and policies with a view to implement the EU principle of solidarity and fair sharing of responsibility as expressed in the Treaty on the Functioning of the European Union and in line with the Stockholm Programme, the European Pact on Immigration and Asylum, the Global Approach to Migration, the relevant European Council Declaration of 11 March 2011 and Conclusions of 24 and 25 March 2011, the JHA Council Conclusions of 11and 12 April 2011 on the management of migration from the Southern Neighbourhood and the JHA Council Conclusions of 25 and 26 February 2010 on 29 measures for reinforcing the protection of the external borders and combating illegal immigration;

Therefore we, the Ministers of Home Affairs and Internal Security of the EU Mediterranean Countries, have adopted a common position on the emerging situation in our region and urge the European Union to practically offer operational as well as financial support to Member States which face mass and disproportionate mixed migration flows, by fully mobilizing all available EU assets, instruments and capabilities, either existing or additional ones,.

Particularly, as the competent Ministers of the EU Mediterranean Member States, urge the European Union to:

Urgently present and implement proposals on the Global Approach to Migration as well as on Mobility Partnerships, in a spirit of genuine cooperation with the countries of the Southern Neighbourhood Region, also to effectively control and manage the current and the anticipated mass migration flows as well as situation-specific schemes on return and readmission.

Call on FRONTEX to immediately implement the provisions set out in section 5 of the JHA Council Conclusions of 11 April 2011, to speed up negotiations with the countries of the region – and in particular with Tunisia – with a view to concluding operational working arrangements, and organising joint patrolling operations in cooperation with Tunisian authorities and in application of all relevant international Conventions, in particular the UN Convention on the Law of the Sea (“the Montego Bay Convention”).

Call on FRONTEX to intensify the monitoring of the situation based on risk analysis and encourage Member States to provide the Agency with further human and technical resources so as to continue its ongoing operations (Joint Operation Hermes, Joint Operation Poseidon Land and Sea and the possible deployment of a RABIT operation in Malta) in the light of the emerging situation. Furthermore, call FRONTEX to expand its operations, where and when necessary, to prevent illegal flows in the eastern Mediterranean area of Egypt and Syria. To this end, further adequate financing of FRONTEX should be considered so as to increase the Organization’s capabilities to fulfil successfully its tasks.

Enhance the operational capacity and the coordinating role of the FRONTEX Operational Office in Piraeus in order to effectively deal with the situation;

Accelerate work on the FRONTEX Amending Regulation with a view to an agreement by June 2011 which will strengthen its capacity, make it truly operational and improve its synergy with other bodies.

Promote practical cooperation with the countries of origin or transit of illegal migrants in the region in preventing and fighting illegal migration flows, inter alia by concluding Readmission Agreements, developing Voluntary Return Programmes, enhancing their capacity of border management and surveillance, expanding the Immigration Liaison Officers Network, promoting legal migration by exploring the possibility of concluding mobility partnerships;

Encourage Member States to expedite discussions on the proposal for recasting the Dublin II Regulation, including a mechanism to suspend the transfers to Member States facing particular pressure on their national asylum systems.

Urgently mobilize all available financial assistance through the External Borders Fund and European Refugee Fund and in addition, as section 4 of the JHA Council Conclusions of 11 April, 2011 reads, activate supplementary funds that can be made available to Member States or FRONTEX at short notice when needed. In this vein establish a special solidarity Fund, when necessary, to tackle exceptional emergency situations and humanitarian crisis.

Deploy every available possibility by the European Asylum Support Office to offer practical support to the Member States of the Mediterranean Region in need. A permanent specialised mechanism should be set up through the EASO, which, at exceptional emergency situations, will provide Member States in need with the necessary logistical and technical support.

As a matter of priority, present a proposal for implementing a coherent and comprehensive mechanism for distributing responsibilities, on a voluntary basis, specifically regarding the relocation of beneficiaries of international protection among member states, in case of European countries faced with particular pressures, as a consequence of their geographical or demographic situation, especially when facing the sudden arrival of third country nationals in need of international protection.

Commit to the work on establishing a Common European Asylum System with a view to respect the 2012 deadline.

We the Ministers of the Mediterranean Member States of the EU agreed to meet again soon, at a date to be agreed, in order to further coordinate our efforts before the European Council of June this year.”

JHA Council Conclusions on the management of migration from the Southern Neighbourhood – 11 April 2011

Excerpts from today’s JHA Council Conclusions:

5. The Council calls on FRONTEX to continue to monitor the situation and prepare detailed risk analyses on possible scenarios with a view to identifying the most effective responses to them, and also invites FRONTEX to speed up negotiations with the countries of the region – and in particular with Tunisia – with a view to concluding operational working arrangements, and organising joint patrolling operations in cooperation with Tunisian authorities and in application of all relevant international Conventions, in particular the UN Convention on the Law of the Sea (“the Montego Bay Convention”).

6. The Council urges Member States to provide further human and technical resources to support the Agency’s operations, and in particular the existing Joint Operations Hermes, Poseidon Land and Sea and the possible deployment of a RABIT operation in Malta, in accordance with needs identified by the Agency in the light of the developing situation.

7. In order to rapidly strengthen the competences of FRONTEX and put more effective tools at its disposal, the Council agrees to accelerate negotiations on amending the FRONTEX Regulation, in cooperation with the European Parliament, with a view to reaching agreement by June 2011.

8. The Council underlines the need to promote all relevant forms of cooperation on a performance-based approach in the field of migration, mobility and security with the countries of the region that are sufficiently advanced in their reform progresses, and that effectively cooperate with the EU and its Member States in preventing illegal migration flows, managing their borders and cooperating in the return and readmission of irregular migrants. The Council stresses the need for early progress in the area of return and readmission in the case of relevant third countries, and recalls in particular that all States have an obligation to readmit their own nationals.

10. The Council welcomes the outcome of the visits of the Presidency and the Commission to Egypt and Tunisia and the intention of the Commission to follow-up these visits by setting up dialogues with the authorities of these countries at senior officials’ level, in which Member States will also participate, and which will be aimed at promoting the swift development of cooperation on the management of migration flows. This dialogue should in first instance, focus on the identification and promotion of measures which can contribute in a concrete and effective way to the prevention of illegal migration, to the effective management and control of their external borders, to the facilitation of the return and readmission of irregular migrants, and to the development of protection in the region for those in need, including through regional protection programmes. Subsequently, this dialogue could explore the possibilities for facilitating people-to-people contacts using instruments such as mobility partnerships.

11. The Council stresses the importance of offering durable protection solutions to those in need of international protection present in the countries of the Southern Neighbourhood, and, in this respect, calls on the Commission and the Council’s preparatory bodies to examine the possibility of assisting those countries in capacity building in the area of international protection, including by activating existing regional protection programmes, and assessing the need for additional programmes in the region.

12. The Council recalls that resettlement of refugees on a voluntary basis, in particular those living for some years in a situation of protracted displacement and vulnerability, and having no other perspective, can represent a durable solution for them. The Council takes note of the willingness of certain Member States to consider offering resettlement opportunities for the refugees present in the region. The Council invites Member States to continue supporting UNHCR in the development of resettlement programmes and calls on the Commission to identify solutions for supporting financially such resettlement actions.

13. The Council underlines that the measures mentioned in the paragraphs above represent the immediate answer to the crisis situation in the Mediterranean, but that it is also crucial to put in place a more long-term sustainable strategy to address international protection, migration, mobility and security in general, and taking also the secondary movements to other Member States into account.

14. The Council welcomes the Commission’s intention to come forward for that purpose with proposals in response to the Declaration of the Extraordinary European Council of 11 March and the Conclusions of the European Council of 24-25 March, and notes that the Presidency stands ready to convene an extraordinary meeting of the Council on 12 May if necessary in the light of developments and to further consider these matters.”

Statement: European Commission’s response to the migratory flows from North Africa

The European Commission released a statement on 8 April summarising its actions.  Excerpts:

Measures addressing the migration flows towards the European Union

Urgent measures already undertaken

The massive displacement of populations from several North African countries has been putting the protection and reception systems of some of the EU Member States, in particular in Italy and Malta, under increasing strain. The European Union has responded to these serious challenges in a rapid and effective manner with the aim of stabilizing the situation.

Frontex has deployed the Joint Operation EPN Hermes Extension 2011 to assist the Italian authorities in managing the influx of migrants from North Africa, most of whom have been arriving on the island of Lampedusa. This mission was launched on 20 February 2011, only four days after receiving the official request from the Italian authorities, a clear signal of solidarity between Member States. FRONTEX stands ready to continue the mission as long as it will be necessary, and to expand it, provided that Member States will make available the necessary staff, vessels and equipment. In view of the above the Commission is launching the necessary procedures for reinforcing the FRONTEX 2011 budget with an additional EUR 30 million.

Europol has also deployed a team of experts to Italy in order to help the national authorities to assist in detecting and preventing possible criminal of trafficking of human beings.

Regarding the financial needs linked with the displacement, the Commission’s four migration-related funds (the External Borders Fund, Return Fund, Refugee Fund and Integration Fund) are available to Member States. For example, Italy, one of the major beneficiaries of these funds, has been allocated €55 million for 2010 and €75 million for 2011. Moreover, the Commission makes available an additional €25 million of emergency funding which can be quickly mobilised under the External Borders Funds and European Refugee Fund.

What measures could be undertaken in the short-term?

Should the inflow of irregular migrants and possible refugees continue, the Commission envisages a number of short-term measures that might be taken.

Reinforcing Frontex

  • 1) The Joint Operation EPN HERMES Extension coordinated by FRONTEX could be considerably strengthened, with additional technical resources made available by Member States, and adequate financial resources.
  • 2) It is essential that FRONTEX is finally given a stronger operational mandate through a revision of its legal basis, which the Commission tabled in February 2010 (IP/10/184)
  • 3) FRONTEX should speed up negotiations to conclude working arrangements with the countries of origin and transit of irregular migration in the Mediterranean in the region (for example, with Egypt, Morocco and Turkey), and receive a mandate to negotiate similar working arrangements with other relevant countries (for instance Tunisia)

Resettlement of third country nationals

The continuous and possible increase in the flow of refugees (e.g. Somalis, Eritreans etc.), in need of international protection, coming from Libyan territory is an issue of major concern. The EU will not only continue to provide humanitarian assistance through its humanitarian office (ECHO), but it is also ready to offer through the European Refugee Fund financial support in view of facilitating the resettlement of persons in need of international protection. Resettlement represents not only a life-saving measure for the refugees concerned, but is also an important responsibility-sharing gesture towards the countries hosting them. Showing solidarity with the countries neighbouring Libya that are under pressure through resettlement can help to maintain ‘protection space’, as well as contributing to dialogue and cooperation on other issues of migration and border management.

The Commission has therefore been encouraging EU Member States to offer resettlement places, in a spirit of responsibility-sharing and in close cooperation with the United Nations High Commissioner for Refugees (UNHCR). A meeting was held with Member States on 25 March at which details of the most urgent needs were explained by the UNHCR and the International Organisation for Migration (IOM), both of whom are actively engaged on the ground in the region.

The current crisis in the Mediterranean clearly demonstrates how imperative it is that the Council and the European Parliament make an effort to rapidly reach an agreement on the adoption of the Commission’s proposal for the establishment of an EU joint resettlement programme. This proposal would provide a structured basis for annual priority-setting, and linking those priorities with financial incentives, thereby encouraging more Member States to become involved in resettlement activities, and enhancing practical cooperation between Member States to that end.

Solidarity / Temporary Protection Directive

In the event of a massive inflow of persons who are likely to be in need of international protection, the Commission would expect Member States to demonstrate concrete solidarity with each other by directly assisting the States bearing the greatest burden. This could involve the relocation to other Member States of some persons seeking protection, or who have already received an international protection status.

Concrete assistance could likewise be provided by the newly-created European Asylum Support Office, one of whose central tasks is coordination of assistance to Member States whose asylum systems are under exceptional pressure. This could involve the deployment of so-called ‘asylum support teams’ to reinforce the capacities of a State to process asylum claims and to ensure appropriate reception conditions for asylum seekers.

The Commission would also be ready to consider proposing the use of the mechanism foreseen under the 2001 Temporary Protection Directive (2001/55/EC), if the conditions foreseen in the directive are met. Consideration could only be given to taking this step if it is clear that the persons concerned are likely to be in need of international protection, if they cannot be safely returned to their countries-of-origin, and if the numbers of persons arriving who are in need of protection are sufficiently great. Resort to this mechanism would allow for the immediate protection and reception in the territory of EU Member States for persons concerned, as well as offering a “breathing space” for the national asylum systems of the Member States most directly affected.

Frattini Criticises EU for Failure to Assist Italy; Frattini and MEPs Call for Implementation of Temporary Protection Directive and Mandatory Burden Sharing

Italian Foreign Minister Franco Frattini has again criticised what he describes as the EU’s and European Commission’s failure to assist Italy with the migrant situation in Lampedusa. Minister Frattini singled out Commissioner Malmström for his criticism.  A statement on the Italian Foreign Ministry web site says that “Italy continues to solicit Europe’s help in confronting the immigration emergency, not only in terms of economic aid but also in terms of a plan for the distribution of the refugees among Member States. ‘Europe has been totally inert in this period’, Minister Frattini asserted and, commenting on EU Home Affairs Commissioner Cecilia Malmström[‘s] observation that Italy had already received European funding for managing the influx, specified: ‘This is the typical expression of a European bureaucracy that thinks money alone solves everything’, but it is not enough, ‘there need to be policy interventions’. …[I]n addition to funds it is necessary to ‘invoke a European law clearly establishing the adoption of an extraordinary plan with any sudden influx of refugees toward one or more Member States, which includes the distribution of the refugees among Members within the temporary timeframe necessary to repatriate those who are not refugees, as in the case of the Tunisians, who are simply economic immigrants’.”

MEPs Simon Busuttil (Malta) and Salvatore Iacolino (IT) issued a press release calling on the Commission “to activate the Solidarity Mechanism envisaged in EU law in cases of mass influx of displaced persons. … ‘EU law already provides for a solidarity mechanism that can be triggered in the event of a mass influx of displaced persons (Council Directive 2001-55-EC)’ [and ‘we call upon the Commission to activate it’] Busuttil and Iacolino said.”

Maltese Minister Says Malta Will Not Reconsider Its Detention of Migrants

Malta Today reports that Justice and Home Affairs Minister Carm Mifsud Bonnici reaffirmed Malta’s detention law and disagrees with the comments made by COE Human Rights Commissioner Thomas Hammarberg.  From Malta Today: “‘This [the detention policy] is compliant with Malta’s EU and other international obligations. As a matter of fact, the European Convention on Human Rights does not rule out detention,’ Mifsud Bonnici said, citing Article 5 (1)(f) of the Convention. … Mifsud Bonnici however said that the judgement in the [ECtHR’s] Massoud vs Malta case, ‘cannot, in any way be interpreted as constituting a condemnation of Malta’s detention policy. This has been proved and explained time and again.’”

500 Migrants Reach Malta from Libya – First Arrivals in 2011

300 migrants arrived in Malta this afternoon.  A second group of approximately 250 is expected to arrive this evening.  The migrants are believed to be Sub-Saharan asylum seekers from Libya.

Under Maltese law, the arriving asylum seekers will be detained.  The law purports to authorise detention for up to 18 months.  Malta’s detention centres are at present largely empty due to the lack of recent migrant arrivals.  COE Human Rights Commissioner Thomas Hammarberg concluded a visit to Malta just last week.  The Commissioner’s report pertaining to his visit has not yet been released, but a statement was released in which the Commissioner called for “the policy of mandatory detention of all irregular migrants, including asylum seekers, [to] be reconsidered.”

Excerpts from the Statement:

“‘Malta and Europe need each other if the challenges of migration are to be met in a manner that respects human rights,’ said the Council of Europe Commissioner for Human Rights, Thomas Hammarberg, following his visit to Malta from 23 to 25 March. According to the Commissioner, Malta needs to move away from a reactive approach to migration and establish a system that is fully in line with European standards concerning the human rights of immigrants and asylum seekers. At the same time, a much more generous and collegial approach is needed on the part of other European states, by accepting to host some of the persons to whom Malta has rightly accorded international protection. ‘However, with the exception of France and Germany – and further afield the US – this has not been the case so far.’

The Commissioner underlined that the current uncertainty related to the events in Libya and possible forced migration towards Malta and Europe should not deter the Maltese authorities from undertaking the necessary reforms. ‘Instead this is another reason for more European solidarity to support these reforms’ said the Commissioner, noting also that the substantial decrease in the number of irregular arrivals in Malta over the last two years has taken considerable pressure off Malta.

In this context, the policy of mandatory detention of all irregular migrants, including asylum seekers, should be reconsidered. The Commissioner notes that the mandatory detention of migrants can hardly be reconciled with the requirements set by the European Convention on Human Rights, as also reflected in a July 2010 judgment of the Strasbourg Court in the case of Louled Massoud, which found that Malta had violated the Convention by detaining an asylum seeker, whose claim had been rejected, for almost 18 months. ‘Malta should take all necessary legislative and other measures in order to implement fully and effectively this important judgment of the European Court of Human Rights’ said the Commissioner. Alternatives to the detention of migrants should be provided for in law, in accordance with the Council of Europe Parliamentary Assembly’s Resolution 1707 (2010). …”

European Council Meeting Conclusions re Migrant and Refugee Flows from North Africa

While most of the European Council meeting of 24/25 March was devoted to economic policy and the Euro Zone crisis, the Council also considered the situation in Libya and the “Southern Neighborhood.”  The Council’s Conclusions noted that the Commission would be presenting “a Plan for the development of capacities to manage migration and refugee flows in advance of the June European Council.”  The Council conclusions also stated that “Agreement should be reached by June 2011 on the regulation enhancing the capabilities of Frontex. In the meantime the Commission will make additional resources available in support to the agency’s 2011 Hermes and Poseidon operations….”

Excerpts from the Council 24/25 March 2011 Conclusions:

“II. LIBYA / SOUTHERN NEIGHBOURHOOD

18. The European Council discussed the situation in Libya and endorsed the conclusions adopted by the Foreign Affairs Council on 21 March. Recalling its March 11 Declaration, the European Council expressed its satisfaction after the adoption of UN Security Council Resolution 1973, which expresses the principle of the responsibility to protect, and underlined its determination to contribute to its implementation. It also welcomed the Paris Summit of 19 March as a decisive contribution to its implementation…. [***]

21. The humanitarian situation in Libya and on its borders remains a source of serious concern. The EU will continue to provide humanitarian assistance to all those affected, in close cooperation with all the humanitarian agencies and NGOs involved. The EU has stepped up and will continue its planning on support for humanitarian assistance / civil protection operations, including by maritime means.  [***]

25. The European Council welcomes the recent visit of Presidency and the Commission to Egypt as part of a first phase of consultations to promote a comprehensive approach to migration as between the countries of the Southern Neighbourhood region and the European Union. In this context the European Council invites the Commission to present its proposals on the Global Approach to Migration as well as on the Mobility Partnership well in advance of the June European Council.

26. The European Council also looks forward to the presentation by the Commission of a Plan for the development of capacities to manage migration and refugee flows in advance of the June European Council. Agreement should be reached by June 2011 on the regulation enhancing the capabilities of Frontex. In the meantime the Commission will make additional resources available in support to the agency’s 2011 Hermes and Poseidon operations and Member States are invited to provide further human and technical resources. The EU and its Member States stand ready to demonstrate their concrete solidarity to Member States most directly concerned by migratory movements and provide the necessary support as the situation evolves.  [***]”

Save the Children: Conditions for 250 Unaccompanied Migrant Children on Lampedusa Unacceptable

Save the Children released a press statement yesterday describing the conditions for more than 250 unaccompanied migrant children on Lampedusa and calling for their immediate transfer from the island.  Excerpts:

“’The structure that has been allocated [to the children on Lampedusa] is totally inadequate and the conditions on an hourly basis are becoming more critical from the point of view of hygiene and [other conditions]’ said Raffaella Milano, Italy-Programs Manager, Save the Children Europe.  Since the beginning of the increased arrivals of migrants from Tunisia – since February 10 – more than 530 children, the vast majority of them unaccompanied, have arrived in Lampedusa.  Of these, 283 have been placed in communities to accommodate the children in Sicily.  ‘More than 250 unaccompanied minors are still remaining in Lampedusa and many have been living many days in conditions that do not guarantee minimum standards of reception.’ …  Save the Children calls for the transfer of the children and setting up temporary structures … if necessary, where the children may stay until being placed within the community. … This delay is not justifiable.”

EMHRN Statement: Italy and EU should suspend all measures of forcible removal towards Tunisia

Press release in its entirety from the Euro-Mediterranean Human Rights Network:

“Brussels, 23 March 2011.  Italy and the other Member States of the EU should suspend all measures of forcible removal towards Tunisia and share in the reinstallation of Libyan and non-Libyan refugees who have to flee Libya

Italian ministers Frattini and Maroni have announced their intention to travel to Tunisia to renew bilateral cooperation on migration issues. In the view of the Euro-Mediterranean Network, in the present circumstances, the ministers’ insistence that the Tunisian authorities must prevent new departures from Tunisia and cooperate in the forcible removal of the Tunisian migrants who have landed in Italy since the beginning of the year, is particularly inappropriate.

The upheavals that are shaking the region at the moment have exposed the short-sightedness and futility of a policy that favours dictators instead of migrants.

Expecting from the Tunisian authorities, first and foremost, a crack down on immigration from third countries and emigration towards the European Union amounts to encouraging them in returning to the authoritarian practices of the former regime. This is not the kind of support Tunisia needs.

In this transition period, Italy and the other member states of the European Union should, on the contrary, suspend all measures imposing the forcible removal of Tunisian nationals towards Tunisia and share in the resettlement of Libyan and non-Libyan refugees who have had to flee Libya, arrived in Tunisia and cannot return to their home country.

While the number of Tunisian migrants who have landed on Lampedusa Island is significant relative to the size and population of the island, it is minuscule, on the European scale, when compared to the scope of the humanitarian emergency confronting Tunisia on its border with Libya. No fewer than 165,000 people have crossed the border at Ras Adjir in an attempt to flee the violence in Libya since 20 February, but no Tunisian official has made inflammatory statements comparing migrants and asylum seekers with criminals or terrorists. Tunisia is forced to cope with the arrival of tens of thousands of Tunisian workers, some of whom had been living in Libya for many years, as well as tens of thousands of immigrant workers, mainly from Bangladesh and sub-Saharan countries, who are awaiting repatriation to their countries of origin with assistance from UNHCR and OIM, not to mention Libyans and nationals of countries such as Somalia, Eritrea or Sudan, who for obvious reasons cannot return to their countries of origin, where their lives and physical integrity would be at risk.”

IOM: New Migrant Arrivals on Lampedusa Lead to Massive Overcrowding

Full text:  “IOM Press Note – Monday 21 March 2011 – New Migrant Arrivals on Lampedusa Lead to Massive Overcrowding —  The arrival of more than 1,630 irregular migrants on the Italian island of Lampedusa on Sunday 20 March and overnight Monday 21st has led to massive overcrowding at the migrant reception centre where IOM and partners monitor reception assistance and provide legal counselling to migrants, asylum-seekers and unaccompanied minors.

With the weekend’s arrival of Tunisian migrants bringing the current number of migrants on Lampedusa to nearly 4,780 and the reception centre built to host 800 people, migrants are being hosted wherever possible around the island.

This includes about 2,000 migrants at the port area which doesn’t have the sanitation facilities needed to host such numbers of people and who for the past few days have been sleeping in the open without adequate protection from the elements and in whatever space they can find.

Among the nearly 4,780 migrants on Lampedusa are about 200 minors. IOM and UNHCR worked with partner Save the Children to find suitable accommodation for all the minors who have arrived in recent days and who could not be left to sleep at the pier with no blankets or mattresses.

IOM also found safe accommodation for 13 women away from the overcrowded reception centre.

With boat landings taking place during the day and night, IOM and partners are working in shifts to ensure assistance is provided 24 hours a day.

Staff report that the situation on the island, which has a population of 5,000, is critical and tense and that rapid transfers to other migrant reception centres elsewhere in Italy are essential.

Since February, around 14,000 Tunisian migrants have arrived on Lampedusa. With migrant reception centres in Puglia in southern Italy and on Sicily also fairly full, Italian authorities have established a centre at an ex-NATO base residence at Mineo on Sicily.

From today, 21 March, IOM staff will be present at Mineo where, as part of an Italian government funded project, the Organization will provide legal counselling to migrants and monitor reception assistance.

The vast majority of the migrants who have arrived on Lampedusa are young men who have left Tunisia either to find employment in Europe or to be united with families. ECRE calls on the EU to rescue sub–Saharan refugees trapped in Libya

Statement in full:

“Brussels, 3 March 2011. In a meeting today with Commissioner for Home Affairs Cecilia Malmström, ECRE urged the European Commission to make an appeal to EU Member States to help evacuate and offer protection to the 4,000 sub-Saharan refugees who are trapped in Libya.

The international community is making important efforts to support the evacuation of Europeans, Egyptians, Tunisians and other foreigners. However, sub-Saharan refugees, mainly Somalis and Eritreans, are not able to get out of Libya to find safety. As de facto refugees, they cannot go back to their own countries, which they fled to save their lives. What is more, suspected of being pro-Gaddafi mercenaries, they are being targeted and are at great risk if they try to reach the Egyptian or Tunisian border.

Bjarte Vandvik, ECRE’s Secretary General, said ‘Persecuted in their own country, persecuted now in Libya and unable to leave the country, sub –Saharan refugees need to be urgently evacuated to Europe’.

PACE President calls for Europe to support humanitarian evacuation from Libya

Statement from Mevlüt Çavusoglu, President of the Parliamentary Assembly of the Council of Europe:  “Refugees and migrants are trapped by the conflicts [in Libya]. In Libya, 8000 persons have been recognised as refugees by the UNHCR and are particularly vulnerable…. UNHCR and IOM have today made a joint appeal to governments around the world to provide support for an emergency humanitarian evacuation ongoing at the moment. I join their appeal by adding my plea: the help of the entire international community is urgently needed, and Europe should be at the forefront of the response to this crisis.”

CERD Issues Urgent Call for Protection of Non-Citizens and Migrants in Libya

Acting pursuant to its early warning and urgent action procedures, “[t]he United Nations Committee on the Elimination of Racial Discrimination called on the international community and the UN system to seek urgent measures to protect non-citizens, migrant populations, migrant workers, refugees and other minority groups in Libya….”

Network Euro Mediterraneo per i Diritti dell’Uomo: Missione di raccolta informazioni in Tunisia e Italia e Raccomandazioni

From CIR:  “…[I]l Network Euro Mediterraneo per i Diritti dell’Uomo ha organizzato una missione di raccolta informazioni, che si è svolta dal 18 al 24 febbraio prima in Tunisia e poi in Italia. La missione era composta da rappresentanti di organizzazioni membro del Network e di partner e da esperti del Nord e del Sud del Mediterraneo. La missione ha potuto raccogliere testimonianze e informazioni dirette, tanto in Tunisia che in Italia.

La missione ha permesso di smentire sia la tesi della presenza massiva tra i migarnti arrivati in Italia di delinquenti di diritto comune evasi dalle carceri, sia quella di un complotto migratorio che sarebbe stato ordito dalla Libia e dai nostalgici di Ben Ali.

Nel corso della missione, le preoccupazione legate agli avvenimenti drammatici che sconvolgono la Libia hanno, in qualche maniera, soppiantato gli interrogativi che circondano i migranti tunisini.

Al termine di questa missione, il Network formula le seguenti raccomandazioni:

Alle autorità italiane:

  • Rispettare la dignità di tutti i migranti, quali che siano le loro motivazioni.
  • Sospendere l’applicazione dell’accordo bilaterale di riammissione con la Tunisia sotto il concluso con il regime di Ben Ali. Sospendere tutte le misure di espulsione forzata individuale o collettiva verso la Tunisia.
  • Richiedere all’Unione Europea l’attivazione del meccanismo di protezione temporanea.
  • Nell’attesa della protezione temporanea, accordare ai migranti una forma di protezione umanitaria che si traduca in un titolo di soggiorno legale in Italia. Misura che deve essere indicata dalle autorità centrali e che non deve essere in alcun modo delegata alla discrezionalità delle singole Questure e Commissioni Territoriali per il riconoscimento della protezione internazionale
  • Migliorare e razionalizzare le condizioni d’accoglienza, il ricorso allo stato d’urgenza umanitaria non può tradursi in un abbassamento degli standard di accoglienza.
  • Astenersi dal mettere in opera il progetto di raggruppamento del Villaggio Mineo, in Sicilia, di tutti i richiedenti asilo in corso di procedura in Italia, misura         che può provocare una situazione di ghetto ed esclusione sociale
  • Assicurare ai migranti che hanno fatto domanda d’asilo un esame individuale della domanda di protezione nel pieno rispetto delle direttive “procedure” e “qualifiche”
  • Astenersi da dichiarazioni allarmistiche e incendiarie che assimilano migranti, delinquenti e terroristi

Alle autorità tunisine

  • Garantire la libertà di tutte le persone di lasciare qualsiasi paese compreso il proprio ( Articolo 12, 2 del Patto internazionale relativo ai diritti civili e politici). Di conseguenza, astenersi di tutte le procedure penali per le persone fermate nel tentativo di lasciare la Tunisia via mare o per quanti sono rimpatriati forzatamente verso il Paese
  • Rispettare pienamente le obbligazioni marittime internazionali relative alla ricerca e al salvataggio in mare.
  • Aprire una inchiesta approfondita e imparziale sulle condizioni nelle quali una barca è affondata l’11 febbraio, in un incidente che è costato la vita ad almeno 5 persone, e perseguirne i responsabili
  • Sospendere l’applicazione dell’accordo bilaterale sul controllo dell’Immigrazione concluso con l’Italia. Esigerne la rinegoziazione e, nel futuro, escludere la possibilità di rimpatri massivi e la sua applicazione a cittadini di paesi terzi.

Alle autorità europee

  • Accompagnare gli Stati dell’Africa del Nord nel processo di transizione in corso, poiché la democrazia è la sola a poter garantire una reale stabilità nella regione, e quindi offrire ai giovani la possibilità di costruire il loro futuro in un paese nel quale possono progettare un avvenire.
  • Aiutare l’Egitto e la Tunisia che, contrariamente all’Europa, sono già stati chiamati ad accogliere rifugiati libici e stranieri, in provenienza dalla Libia. La solidarietà a cui si appellano gli Stati del Sud dell’Unione Europea deve esprimersi innanzitutto nei confronti di questi Stati in transizione
  • Astenersi da tutte le operazioni che avrebbero come conseguenza la dissuasione o l’impedimento dell’arrivo in Europa di persone che avrebbero bisogno di protezione
  • Prepararsi all’attivazione della direttiva sulla “protezione temporanea” nel caso si producano arrivi massivi dal Nord Africa.”
