Clarification of Frontex Data On Persons Detected at EU External Borders – Includes Significant Double Counting

Yesterday Frontex released updated monthly data showing that 710,000 migrants crossed the EU’s external borders from January to September 2015. In a Twitter exchange with Nando Sigona (Univ. of Birmingham and Univ. of Oxford), Frontex clarified that it counts an individual migrant each time she crosses an external border; according to Frontex, “[t]his means that a large number of the [710,000] people who were counted when they arrived in Greece were again counted when [after passing through Greece, they entered] the EU for the second time through Hungary or Croatia.”

The 710,000 figure that was widely reported yesterday may overstate the number of individuals crossing the external borders by several hundred thousand. For example, Frontex reported that 350,000 migrants arrived in the Greek islands during the first nine months of 2015 and that 204,000 migrants crossed into Hungary during the same time period. Presumably a majority (or at least a very significant portion) of the migrants crossing into Hungary initially entered the EU via Greece and were counted at that time. Many of the tens of thousands of migrants who crossed into Croatia likewise presumably first entered the EU through Greece.

Frontex did add a disclaimer to its web site explaining the double counting: “Clarification: Frontex provides monthly data on the number of people detected at the external borders of the European Union. Irregular border crossings may be attempted by the same person several times in different locations at the external border. This means that a large number of the people who were counted when they arrived in Greece were again counted when entering the EU for the second time through Hungary or Croatia.”

And to be fair, Frontex has at times previously acknowledged that its figures include double counting. See the press statement from 14 September reporting 500,000 migrants having been detected at the external border: “However, a large number of the persons detected at the Hungarian border with Serbia had already been counted when they arrived in Greece from Turkey a few weeks earlier.” But the fact remains that much of the news coverage generated by the Frontex data will not explain the double counting.

HRVP Mogherini’s Summary of Informal Meeting of EU Foreign Ministers on Refugee Crisis: The meeting “was not an easy one…”

These are excerpts/highlights from comments made by HRVP Federica Mogherini at the conclusion of Saturday’s, 5 September, informal meeting of EU foreign ministers. The full text of her remarks is here.

  • “[W]e need to start using the right words: [the crisis] is partially a migrant flow, but it is mainly a refugee flow, which puts us in a different situation when it comes to our legal and moral duties.”

And I have found a large consensus about that need for the naval operation. Obviously, we will also need to increase the level of our actions against the traffickers organisations on the mainland, when it comes to the Western Balkans route.
    • Fourth, strengthening our partnership with third countries, mainly countries of origin and transit. Here, obviously, we are working on readmission and return agreements, but not only. We know very well that it is very important for our partners, especially in Africa and the Middle East, to work together with us on economic developments, opportunities for growth and jobs, especially for their young people. …
    • Fifth point, that is maybe the most important, even if it is the most long term plan – it is our common work on what we call the root causes. In this case, that has mainly two aims. One is Libya, when it comes to the Southern corridor. And here, we have re-expressed all our active support to the last phases… hopefully, the last phases of the UN-led negotiations to form a National Unity Government in Libya. … And [the other is] Syria…”

HRC Adopts Resolution on Migrants and Asylum Seekers Fleeing North Africa; Calls for Inquiry Into Allegations of Failures to Rescue Boats in Distress

The UN Human Rights Council, 17th Session, on Friday, 17 June, adopted a resolution (A/HRC/17/L.13) on Migrants and Asylum Seekers Fleeing from Events in North Africa.  The Resolution recalls states’ obligations under human rights, humanitarian, and refugee law, including the obligation of non-refoulement and called for ships patrolling the Mediterranean Sea to provide assistance to non-seaworthy boats leaving North Africa.

The Resolution also calls for “a comprehensive inquiry into the very troubling allegations that sinking vessels carrying migrants and asylum seekers fleeing the events in North Africa were abandoned to their fate despite the alleged ability of European ships in the vicinity to rescue them, and welcomes the call made by the Council of Europe in this regard on 9 May 2011.”  [NB – this quoted text is taken from a 15 June version of the Resolution and may not reflect the final approved language. frenzen]

The Resolution was adopted by a vote of 32 in favour, 14 against, and no abstentions:

Excerpts from the Afternoon 17 June summary of the HRC meeting:

“OSITADINMA ANAEDU (Nigeria), introducing draft resolution L.13, said the African Group recognized that due to the recent crisis situation in North Africa, migrants had suffered great hardship. Migrants were fleeing, not flowing out of North Africa. People were running away because their lives were at risk. Other root causes for migration did not apply in this case.  This resolution had been difficult to establish. Nigeria thanked all partners for their efforts in developing the draft resolution. The information emanating from North Africa was such that while neighboring countries did quite a lot in accommodating migrants, there were substantial difficulties in traveling from North Africa. Some people had even died at sea. Nigeria took note that some countries did provide assistance through their offices of migration or other mechanisms. The hardship suffered by migrants should be investigated in order to clarify the problems that arose and ensure this situation was not repeated. Nigeria believed that the Special Rapporteur, working with the High Commissioner, would be able to provide information about how to deal with such a situation in the future. The African Group would appreciate if the draft resolution would be approved by consensus.

ANDRAS DEKANY (Hungary), speaking on behalf of the European Union in an explanation of the vote before the vote, noted that the European Union had assisted greatly with the humanitarian effort in Libya. From the outset the European Union had been at the forefront of humanitarian response. The European Union had been active in repatriating third country nationals.  This had been vital in reducing the stress on neighboring countries. The draft text was circulated late. The European Union had engaged in a constructive spirit on the text, while retaining a specific focus that would address the issue at stake in a more balanced and legally accurate manner, notably when referring to issues related to refugee law and law of the sea. It noted that this was particularly true with regard to PP7 and operative paragraphs, which introduced new language that was not consistent with public international law. The resolution did not capture the multi-dimensional aspects of the problem. There was no reference to the overall human rights situation in the region, and therefore the root causes of the plight of migrants.  The resolution did not refer to the responsibility of criminal traffickers and continued to characterize the situation in an unbalanced way. The European Union and its Member States had continued to observe the principle of non-refoulement. Not a single refugee had been subjected to refoulement. The European Union called for a vote and noted that it would vote against the resolution.

EILEEN CHAMBERLAIN (United States), speaking in an explanation of the vote before the vote on L. 13, said the United States shared concern for the migrants and asylum seekers fleeing the violence in Libya. A resolution requiring countries to recognize their obligations under international law and support victims of violence and migrants from Libya was important.  However, this resolution assigned the sole responsibility to countries of destination and avoided reference to the root causes of the problem. The draft resolution used language that misconstrued State obligations and responsibilities regarding those migrants and asylum seekers. The sponsors had delayed introduction of the draft resolution, thus allowing only a restricted period to review and provide comments on the draft resolution. The United States regretted that the manner the resolution was developed belied its importance and sent the wrong message to the Gaddafi forces.”

Most EU States View Italy’s Concerns Over Refugee Threat As Grossly Exaggerated

The JHA Council yesterday rejected Italy’s call for a stronger EU response to what it describes as an impending migrant flow from North Africa consisting of hundreds of thousands of migrants and asylum seekers.  Several EU governments described the Italian request as one that was based on exaggerated fears.  Hungary’s interior minister, Sandor Pinter, told reporters that “we shouldn’t paint the devil on the wall until he appears.”  German Interior Minister Thomas de Maiziere said “we shouldn’t be painting horror figures and encouraging refugees to come to Europe.”  Another accused Italy of “crying wolf.”

IOM spokeswoman Jemini Pandya said that while Italy should not shoulder a refugee burden on its own, no Libyans have arrived in Italy to date and she rejected the Italian estimates:  “I don’t think in any shape or form you are going to see one-and-a-half million migrants suddenly flood into Europe.  That is really not going to happen at all.  That would really be fear mongering to the extreme.”

Italy has done itself and neighbouring countries a disservice by repeatedly speaking of an “exodus of biblical proportions” and by suggesting that many hundreds of thousands of migrants are poised to take to the sea to try to reach Italy and Malta from Libya.  These estimates are in all likelihood grossly exaggerated.

But even if you agree that Italy’s feared numbers are exaggerations, the fact that no irregular migrant or asylum seeker has apparently yet left Libya by sea is not at all surprising.  Libya is in chaos and few people are likely to try to depart the country by sea until the level of violence begins to diminish.  Libya has (or had) a functioning network of human traffickers and they will be ready to begin exploiting the chaos and to take advantage of desperate people seeking to flee at some point in the future.  If Gaddafi manages to remain in power, once he is no longer concerned with his personal survival, his thoughts will at some point turn to revenge.  Libya will presumably cease cooperating with Italy on the bi-lateral pushback practice, and Gaddafi will tolerate or encourage irregular migration towards Europe.  So Italy is correct in that there is a real threat of significant numbers of migrants and asylum seekers leaving from Libya some time in the near future.  The numbers could easily and quickly surpass the 6,000 who have left Tunisia for Lampedusa.  Could the numbers surpass 30,000?  30,000 asylum seekers entered Sweden last year (population 9 million – Italy’s population is 50+ million) and Sweden has not received any extraordinary EU assistance as a result.  Could the numbers exceed the hundreds of thousands that fled the Balkan wars in the 1990s?  Possible, but probably not very likely.

Correction-Libyan Govt Summoned Hungarian Ambassador, Not EU Rep

According to a more recent Reuters Africa report, the Libyan threat to halt cooperation on immigration was communicated this past Thursday to the Hungarian Ambassador in Tripoli.  This information was then released by the Hungarian EU Presidency.
