Statewatch Analysis: The EU’s self-interested response to unrest in north Africa: the meaning of treaties and readmission agreements between Italy and north African states

Statewatch released an Analysis by Yasha Maccanico entitled “The EU’s self-interested response to unrest in north Africa: the meaning of treaties and readmission agreements between Italy and north African states.”  The Analysis provides a description of Italy’s responses to the migrant arrivals in 2011 caused by the unrest in North Africa.

Excerpts:  “The ‘crisis’ reveals questionable practices and routine abuses – The measures adopted in response to the increasing number of migrants arriving from north African countries serve to highlight a number of practices that have become commonplace in Italy in recent years.

The first of these is a widening of the concept of ‘emergency.’ Calling an emergency gives the government a wider remit to derogate from specified laws so as to resolve situations that cannot be dealt with through ordinary measures….

Although the situation in north Africa was worrying, the emergency was called when slightly over 5,000 migrants had arrived. An analysis by Massimiliano Vrenna and Francesca Biondi Dal Monte for ASGI notes that the government has repeatedly called and extended states of emergency since 2002 to deal with immigration, which is treated as though it were a “natural calamity” even when there is a wholly predictable influx of people from third countries. The urgent need specified in decrees declaring a state of emergency is to conduct ‘activities to counter the exceptional – later referred to as massive – influx of immigrants on Italian territory’ (as happened on 11 December 2002, 7 November 2003, 23 December 2004, 28 October 2005, 16 March 2007, 31 December 2007, 14 February 2008 for Sicily, Calabria and Apulia and was extended to the whole nation on 25 July 2008 and 19 November 2009), stemming from a prime ministerial decree of 20 March 2002. Thus, Vrenna and Biondi Dal Monte’s observation that the emergency is ‘structural’ appears well-founded. It has serious repercussions for the treatment of migrants (see below) and the awarding of contracts outside of normal procedures, with the involvement of the civil protection department whose competencies have been expanding considerably.

The second practice involves the expulsion, refoulement or deportation of migrants outside the limits and procedures established by legislation for this purpose. The failure to identify people, to issue formal decisions on an individual basis to refuse them entry or expel them, or to give them the opportunity to apply for asylum or other forms of protection, was a key concern when boats were intercepted at sea and either the vessels or their passengers were taken back to Libya between May and September 2009, when 1,329 people were returned. These rights were also denied to people arriving from Egypt and Tunisia in application of readmission agreements in the framework of the fight against illegal migration. Their presumed nationality was deemed sufficient to enact expulsions to these countries, because ongoing cooperation and good relations with Italy appeared sufficient to indicate that they were not in need of protection, regardless of the situation in their home countries. ….

The third practice is the ill-treatment of migrants held in detention centres. Without dealing with this issue in depth, it is worth noting that what could be viewed as arbitrary detention is occurring on a large scale, in the absence of formal measures decreeing detention and without the possibility of appealing against decisions. In fact, after landing, migrants are summarily identified as either ‘illegal’ migrants or asylum seekers, largely on the basis of their nationality….”

3rd Anniversary of Italy-Libya Treaty on Friendship, Partnership and Co-operation

This past Tuesday, 30 August, marked the third anniversary of the signing of the Treaty on Friendship, Partnership and Co-operation by Italy and Libya.  The Agreement was signed in Benghazi in 2008 by Prime Minister Silvio Berlusconi and then Libyan leader Gaddafi.  The Agreement included a provision calling for the “intensification of the ongoing cooperation in the context of the fight against terrorism, organized crime, drug trafficking and clandestine migration.” (See p. 2 of UNHCR’s Third Party submission to the European Court of Human Rights in the case of Hirsi and Others v. Italy (Application no. 27765/09) for more information regarding the history of the Agreement.)  The Agreement, which included a provision for the payment by Italy to Libya of $5 billion in compensation for colonial occupation, paved the way for Libya’s implementation of the  provisions of an earlier agreement signed in December 2007 which provided the basis for joint Italy-Libya maritime patrols and Italy’s so-called “push-back” practice.  The first push-back operations began in May 2009.  As I’ve noted in previous posts, the Libyan NTC has given Italy assurances that a new Libyan government will honour the terms of the Friendship Agreement.

Commission Communication on Migration of 4 May

The European Commission today issued a Communication on Migration (COM(2011) 248 final) in response to the ongoing arrivals of migrants and asylum seekers in Italy and Malta and in response to the calls by Italy and France for changes in the implementation or interpretation of the Schengen Agreement.

France has welcomed the Commission’s Communication: “We note with interest that the Commission is considering establishing a mechanism for the temporary reintroduction of controls on some sections of internal borders in cases of difficulties or failures of a Member State. We also welcome the emphasis on strengthening the operational capacity of Frontex, the prospect of ultimately creating a European border guard that France has repeatedly called for. Finally, we welcome with satisfaction the intention of the Commission to propose a suspension clause of the liberalization of visa abuse.” (“Nous relevons ainsi avec intérêt que la Commission envisage l’établissement d’un mécanisme permettant la réintroduction temporaire des contrôles à certaines sections des frontières intérieures en cas de difficultés ou de défaillances d’un État membre. Nous nous félicitons aussi de l’accent mis sur le renforcement des capacités opérationnelles de FRONTEX, avec la perspective de créer à terme un système européen de garde-frontières que la France a régulièrement appelé de ses vœux. The purpose of this Communication is to set recent and future policy proposals in a framework that takes account of all relevant aspects and allows the EU and its Member States to manage asylum, migration and mobility of third-country nationals in a secure environment.

The continuously evolving situation in our Southern Neighbourhood requires rapid responses. Building upon the European Council Conclusions of 11 and 25 March, the European Parliament’s Resolution of 5 April1, and, the joint Communication of the Commission and the High Representative of 8 March, the Commission will present on 24 May a package of proposals to ensure a coherent EU approach in the area of migration, mobility and security with the Southern Mediterranean countries.

However, the need to address this challenging and evolving situation should not lead to a short-term approach limited to border control without taking account of long-term issues.

The EU should also ensure that it has in place safe and efficient asylum procedures for people in need of protection. Sixty years after the signature of the Geneva Convention on the Status of Refugees, it is time for the EU to reaffirm its commitment to offer protection to any persecuted third country national or stateless person arriving on its territory. A Common European Asylum System, offering a high level of protection and reducing the disparities among Member States’ asylum systems, must be completed by 2012, as agreed by the European Council.

At the same time, as recent events have starkly illustrated, the EU continues to face serious challenges in the development of its migration policy. The vulnerability of some sections of the EU’s external borders is a clear example, notably in the Southern Mediterranean and at the land border between Greece and Turkey. In particular, measures must be taken to prevent large numbers of irregular migrants, often exploited by unscrupulous criminal networks, from arriving in the EU. The EU should accordingly pursue a migration policy based on ensuring that inward migration is effectively managed and ensure that the need for enhanced mobility does not undermine the security of the Union’s external borders. While this Communication naturally focuses on regions of most immediate concern, the EU’s migration policy follows a geographically comprehensive approach.

However, while the current crisis confirms the need for increased solidarity at the European level and better sharing of responsibility, it must be recognised that the EU is not fully equipped to help those Member States most exposed to massive migratory movements.

Building on the experience gained so far with the current pilot project on relocation from Malta, the Commission will support an extension of this project in view of the current influx of migrants seeking international protection there, to be implemented in close cooperation with the United Nations High Commissioner for Refugees and the International Organisation for Migration.

However, the currently available instruments fall short of fulfilling all the needs and providing a comprehensive response. They can only be resorted to in an ad hoc manner, and are entirely dependent on the will of Member States to voluntarily offer assistance – in whatever form – at a given point in time. This in turn exposes the EU to criticism and risks undermining the trust of the citizens in the EU.

The Commission will closely monitor the continuously evolving situation and may decide, if the relevant conditions are met, to trigger the Temporary Protection Directive3 to provide immediate and temporary protection to displaced persons from third countries that are unable to return to their country of origin.

The Commission will make further proposals during 2011 on delivering solidarity in a holistic manner and how concretely such assistance can be delivered. A number of different approaches are currently being studied, with a view to developing alternatives that will allow urgent needs to be responded to in a more rapid and structured fashion. This initiative will build on the appropriate legal basis of the Lisbon Treaty, such as Articles 80 and 78 paragraph 3, and will draw lessons from the situation in Greece, particularly at the land border between Greece and Turkey, and the crisis in the Southern Mediterranean; it will include possible ad hoc measures to be resorted to in case of particular temporary pressure on one or several Member States, as well as more structural means of ensuring solidarity, both financial and in the form of practical cooperation and technical assistance (e.g. via FRONTEX, EASO, joint operations).

FRONTEX’s role is key in channelling resources to places where the border is under pressure, as shown by the deployment – for the first time ever – of rapid border intervention teams to the Greek-Turkish land border in 2010 and the deployment of the joint naval operation HERMES to support Italy in 2011. FRONTEX’s legal framework needs be updated to allow it to be more effective in terms of its operational capacity to act at the external border. The Commission proposed the necessary changes in February last year5 and it is now urgent, especially in the light of recent events, that the Council and the Parliament approve this proposal before the end of this semester, as called for by the European Council.

[A] clear system for Schengen governance is needed. Currently the Union still relies on an intergovernmental system of peer reviews to ensure the application of the common rules. The current revision of the Schengen evaluation mechanism should be based on a Community approach with participation of experts from Member States, FRONTEX and lead by the Commission. The proposed mechanism would ensure more transparency and improve the follow-up of shortcomings identified during the experts’ evaluations. The Commission will also issue guidelines to ensure a coherent implementation and interpretation of the Schengen rules.

A mechanism must also be put in place to allow the Union to handle situations where either a Member State is not fulfilling its obligations to control its section of the external border, or where a particular portion of the external border comes under unexpected and heavy pressure due to external events. A coordinated Community-based response by the Union in critical situations would undoubtedly increase trust among Member States. It would also reduce recourse to unilateral initiatives by Member States to temporarily reintroduce internal border controls or to intensify police checks in internal border regions which inevitably slow down the crossing of internal borders for everyone. Such a mechanism may therefore need to be introduced, allowing for a decision at the European level defining which Member States would exceptionally reintroduce internal border control and for how long. The mechanism should be used as a last resort in truly critical situations, until other (emergency) measures have been taken to stabilise the situation at the relevant external border section either at European level, in a spirit of solidarity, and/or at national level, to better comply with the common rules. The Commission is exploring the feasibility of introducing such a mechanism, and may present a proposal to this effect shortly.

One of the main purposes of the Common European Asylum System is to reduce the wide divergence in the outcome of asylum applications lodged in different countries of the EU, and to ensure a common set of procedural and substantive rights which can be relied on across the Union, while ensuring full compliance with the 1951 Geneva Convention on refugees and other relevant international obligations.

In 2010, there were some 257 800 asylum seekers registered in the EU, or 515 applicants per million inhabitants. Ten Member States accounted for more than 90% of applicants registered in the EU17.

It is time to complete the Common European Asylum System by reaching agreement on a balanced package by the 2012 deadline agreed by the European Council in December 2009. To that end, the Commission will shortly put forward modified proposals on the Reception Conditions and the Asylum Procedures Directives. A balanced agreement on the revision of the Dublin Regulation must be reached, including on a last resort emergency mechanism in case of exceptional pressures, and on the revised Eurodac system.

MEPs Express Concern Over Possible Changes to Schengen Rules

According to an EP press release, during Monday’s LIBE meeting, MEPs expressed concern over the “Commission’s announcement that it is considering a temporary reintroduction of checks at the EU’s internal borders.”

From the EP press release:

“‘Schengen governance is suffering too much from inter-governmentalism’, said the Commission representative [at the LIBE meeting], adding that the Commission would table a communication on the issue on 4 May. The Commission paper will seek to ‘replace the unilateral re-introduction of border controls by a Community mechanism’. This would enable the Commission temporarily to impose checks at national borders, in exceptional circumstances and as a last resort.  [Click on this link [DRAFT 15-04-2011] for a draft version of the Commission Communication on Migration.]

‘The decision would be taken collectively, and not unilaterally as is now the case’, said the Commission representative, pointing out that, at present, Member States’ decisions to restore internal border checks cannot be challenged before the European Court of Justice.

‘Schengen should not be weakened’, said Civil Liberties Committee rapporteur Carlos Coelho (EPP, PT), asking for ‘some precaution’ on this issue….

According to the Commission representative, the 4 May communication, to be unveiled ahead of the extraordinary meeting of the Justice and Home Affairs Council on 12 May and of the European Council in June, will provide a long-term perspective for migration policies.

The communication will focus on the management of the Schengen area and propose ways to improve the administration of the visa system. It will also address the common asylum system, which needs to overcome the current impasse in the Council, and the ‘security and mobility partnership’….

‘This is not a Schengen problem, this is a social problem’ to do with migration, said Birgit Sippel (S&D, DE), adding that ‘I am bothered about the timing’ of these requests by Sarkozy and Berlusconi.

The ‘Council is not willing to deal with migration’, added Judith Sargentini (Greens/EFA, NL). Concerning the reintroduction of border controls, she called for a clear definition of ‘temporary’. Franziska Keller (Greens/EFA, DE), asked ‘Which are the specific cases and who decides what is an emergency or not?’…”

Northern League Issues Ultimatum to Berlusconi Over Migration Issue

Northern League leader Umberto Bossi has issued an ultimatum to Silvio Berlusconi demanding a parliamentary vote to set a date certain by which Italy would halt its involvement with NATO operations against Libya.  The Northern League’s basic argument is that ongoing NATO attacks against Libya will lead to larger numbers of migrants and asylum seekers fleeing to Italy.  Interior Minister Roberto Maroni (Northern League) repeated yesterday his belief that up to 50,000 people may soon flee Libya towards Italy.

Italy to Begin Two Daily Repatriation Flights to Tunisia; Frontex Also Seeking Agreement with Tunisia to Expedite Returns

Prime Minister Silvio Berlusconi said two daily repatriation flights to Tunisia will begin today, Monday.  Frontex Director Ilkka Laitinen said Frontex is “trying to put in place ‘as soon as possible’ a new protocol with Tunisia on sending back irregular migrants….  Laitinen told a group of journalists in Brussels on Friday (9 April) that: ‘For the time being there have been no joint returns to Tunisia co-ordinated by Frontex, as we have no working arrangement with the relevant authority.’”

Tunisia Denies Reaching Migration Agreement with Italy; Berlusconi Travels Today to Tunis for Talks

Responding to statements made by Italian Ministers Maroni and Frattini that Tunisia was not complying with recent migration agreements reached during their 25 March visit to Tunis, a Tunisian Foreign Ministry source said on Saturday that no such agreement was finalised or signed.

A statement summarising the 25 March meeting between Italy and Tunisia, previously posted on the Tunisian Ministry of Foreign Affairs web site, said in relevant part that “bilateral and regional cooperation has also been discussed during this meeting, particularly regarding the management of migration flows and within the framework of a comprehensive and integrated approach.  As such, both sides agreed to conclude in the near future an agreement on joint management of migration and development in solidarity like agreements signed with other partner countries.” (“La coopération bilatérale et régionale a été, également, évoquée au cours de cette réunion, notamment, en ce qui concerne la gestion des flux migratoires et ce dans le cadre d’une approche globale et intégrée.  A ce titre, les deux parties ont convenu de conclure dans un proche avenir un accord relatif à la gestion concertée de la migration et au développement solidaire à l’instar des accords signés avec d’autres pays partenaires.”

Berlusconi Visits Lampedusa and Promises All Migrants Will be Moved Within 60 Hours

Prime Minister Silvio Berlusconi visited Lampedusa this afternoon and said that all 6000 migrants now on the island would be moved to new locations within Italy, in Sicily and elsewhere, within 48-60 hours.  He indicated that a navy ship and multiple civilian ferries would be used to transport the migrants.  He promised a massive clean-up operation and beautification programme for the island, announced there would be a tax holiday for island residents, said Lampedusa would be nominated for the Nobel Peace Prize, and said that he had just purchased a personal home on Lampedusa.

Berlusconi said new unspecified measures were being taken to prevent new migrant arrivals.  He seemed to say that some vessels that could be used for the transport of migrants from Tunisia have been purchased by Italy (or by him?).  (“Abbiamo attuato anche misure imprenditoriali. Ve ne diro’ una variopinta: abbiamo comprato pescherecci affinche’ non possano essere utilizzati per le traversate.” “We have also implemented business measures. I will tell you [something] colorful: we bought vessels so they can not be used for the crossings.”)

There has been a lull in migrant arrivals to the island; no new boats from Tunisia or Libya arrived overnight.

Libyan Rebel Leader Jalil Promises to Respect Immigration Agreements Between Libya and Italy

Libyan rebel leader, Mustafa Abdel Jalil, president of the Libyan Transitional National Committee, has promised that a post-Gaddafi Libyan Government will respect “all agreements with Italy by the [Gaddafi] regime, including those involving combating illegal migration and oil contracts with Eni.”  The promise was made during an interview yesterday on the Porta a Porta programme on Rai 1.  According to ANSA, Jalil said he will “respect the Italian-Libyan Treaty signed by Prime Minister Silvio Berlusconi and Colonel Muammar Gaddafi. … Any treaty or agreement [which was done] we respect it” and “we will try to implement the treaties.”  Jalil defected from the Gaddafi government last month.  He was previously Gaddafi’s Minister of Justice.

Frattini and Berlusconi Slow to Criticise Gaddafi

As reported by the EU Observer, while the EU and most member states are now condemning Libya’s actions, “[o]n the other side of the EU divide, Italy is horrified at the possible loss of a close ally. Foreign minister and ex-EU-commissioner Franco Frattini is trying to convince other European states that Mr Gaddafi has promised constitutional reforms and that the bloc should allow him to make good. ‘Italy as you know is the closest neighbour of both Tunisia and Libya so we are extremely concerned about the repercussions on the migratory situation in the southern Mediterranean,’ Mr Frattini told reporters on Sunday. The previous day, Prime Minister Silvio Berlusconi said he did not want to ‘disturb’ his long-time friend with appeals for restraint.”

WikiLeaks 2008 US Cable: Background Regarding EU-Libya Framework Agreement Negotiations

This cable provides the views of the US Embassy in Tripoli regarding the state of the EU-Libya Framework Agreement negotiations in July 2008.  It was written by the US Embassy’s Chargé d’Affaires, John Godfrey.  The cable is titled: “THE EU-LIBYA FRAMEWORK AGREEMENT: VENI, VISAS, VETO.”  The cable states that Libya views the EU Framework Agreement as “a ‘reward’ for Libya’s decision in July 2007 to release six [Bulgarian and Palestinian] health workers accused of intentionally infecting over 400 Libyan children with HIV/AIDS.”  The cable describes threats to veto the framework agreement by individual EU member states in an effort to secure bi-lateral concessions from Libya and describes Libya’s claim that the “draft language initialed by [EU] Commissioner Ferrero-Waldner ‘commits’ the EU …  to funding a ‘surveillance mechanism’ along Libya’s land and sea borders to combat illegal migration.”

Most of the cable’s text follows:

“(C)  Summary.  The Government of Libya (GOL) remains keenly interested in pursuing a European Union-Libya Framework Agreement and views a more formalized partnership with the European Union (EU) as a “reward” for Libya’s decision in July 2007 to release six foreign health workers accused of intentionally infecting over 400 Libyan children with HIV/AIDS. Certain EU members, unsure that a more formal cooperation mechanism would be beneficial and sensing Libya’s eagerness, have used the threat of a veto to push their bilateral agendas, particularly with respect to commercial and human rights issues.  One year after Libya and the EU agreed in principle to pursue an agreement, a sizeable perception gap exists between the two sides on the merits of a more formalized partnership.  Despite occasional differences with the EU, most recently over the French-backed Union for the Mediterranean proposal, the GOL will continue to seek an EU framework agreement, in large part because of Muammar al-Qadhafi’s desire to be taken seriously by European leaders. BULGARIAN MEDICS CASE HAUNTS EUROPE

2.  (C)  Libya’s much-heralded decision in July 2007 to [release] six foreign health workers imprisoned since 1999 on charges of intentionally infecting children in Benghazi with the HIV/AIDS virus frames current discussions on an EU-Libya Framework Agreement.  Widely seen by Europeans in Libya as a successful alignment of European and Libyan interests, the denoument of the Bulgarian medics case – particularly their immediate pardon upon their arrival in Bulgaria – remains a lasting embarrassment for key elements of the Libyan regime.  The GOL, preoccupied with avoiding the public perception that it caved to foreign pressure to resolve the case, has trumpeted a putative EU framework agreement as a significant concession and a positive coup for Libyan diplomacy.  In an hours-long televised news conference just days after the medics left, Foreign Minister Abdulrahman Shalgham and Under Secretary for European Affairs Abdulati Obeidi boasted that a draft agreement, initialed by EU Commissioner for External Relations Benita Ferrero-Waldner during her July 2007 visit to Tripoli, would pave the way for easier access to Schengen visas for Libyan citizens and increased EU infrastructure investments in Libya. Ferrero-Waldner’s announcement in February 2008 that the EU Commission had submitted a recommendation to the Council of Ministers to grant a mandate to open negotiations with Libya stoked GOL hopes for rapid progress.

3.  (C)  French, Spanish, and German diplomats describe Libya’s primary objective in pursuing an EU framework agreement as reducing the mandatory waiting period for Schengen visas for Libyan nationals from the current 10 days to 48 hours.  …

4.  (C)  The July 2007 EU-Libya draft also lays out cooperation in the fields of human rights, health, and development.  U/S Obeidi informed French Ambassador Francois Gouyette in June 2008 that Libya agreed in principle to negotiate a human rights chapter within the framework agreement; however, Obeidi categorically refused to include discussions of individual human rights cases in the EU negotiations.  … In addition, the GOL has claimed that draft language initialed by Commissioner Ferrero-Waldner “commits” the EU …  to funding a “surveillance mechanism” along Libya’s land and sea borders to combat illegal migration.

VENI, VIDI, VETO

5.  (C)  Certain EU members, sensing Libya’s eagerness to move ahead, have threatened to block a framework agreement as a means by which to secure bilateral concessions, chiefly on commercial and human rights issues.  Italian Economic and Commercial Counselor Domenico Bellantone said that Italy is prepared to veto any framework agreement unless Libya ends a series of discriminatory commercial practices that target Italian firms operating in Libya.  …  French and Greek diplomats in Tripoli have hinted that they may also dangle a veto threat to resolve commercial disputes.  The Netherlands have approached certain EU members about a possible veto over Libya’s outstanding private debt to Dutch firms. Danish Consul-General George Wallen recently told EU Ambassadors in Tripoli that Denmark would veto a framework agreement with Libya unless the GOL lifts bans on Danish imports and Danish participation in infrastructure projects in Libya (prompted by a Danish magazine’s re-publishing in February 2008 of cartoons depicting the Prophet Muhammad).  Denmark also wants the GOL to release Jamal al-Hajj, a Danish-Libyan dual-national arrested on February 16, 2007 in connection with plans to hold a peaceful political demonstration.  Maltese diplomats have said Malta is considering a veto over dissatisfaction with Libya’s maritime patrols in its designated Search and Rescue (SAR) area and continuing concerns over the lack of cooperation by the GOL in efforts to stem the flow of irregular migrants from Libya to Europe.

6.  (C) European diplomats believe that apart from help in combating illegal migration from sub-Saharan Africa and South Asia through Libya to Europe, Europe has little to gain from a closer partnership with Tripoli.  In absence of a more formal agreement, some European countries have pursued bilateral cooperation that they privately assess as being more nimble and effective than broader cooperation under an EU framework agreement might be.  Italian diplomats characterized a recent donation of six vessels to Libya’s coast guard and an offer to train Libyan border security officials as Italy’s bilateral response to what they view as a lack of meaningful EU engagement on illegal migrant flows through Libya.  Greek DCM Ioannis Stamatekos lauded Italy’s move and said Greece may follow suit. Maltese Poloff Daniel Malina said that Malta, lacking resources to make a large equipment donation, hoped to keep the critical migration issue on the EU’s radar during Council deliberations over the Commission’s mandate to pursue the framework agreement.

7.  (C)  Twelve months have passed since Ferrero-Waldner initialed a draft memorandum on an EU-Libya framework agreement; however, a year of inaction does not appear to have dampened GOL perceptions that relations with Europe are on an up-swing. While senior European diplomats in Tripoli are quick to point out that formal negotiations with Libya on any kind of European-Libyan cooperation agreement have yet to even begin, many GOL officials speak of key Libyan negotiating positions, such as the 48-hour Schengen visa point, as if they’re already in place. …  A series of high-level European visits, most recently that of Spanish Foreign Minister Miguel Moratinos, have helped attenuate the GOL’s disappointment over what it perceives as slow progress on the framework agreement and on implementing commitments made during al-Qadhafi’s visits to Spain and France in December 2007.

8. (C) Comment: Libya’s interest in a closer partnership with Europe seems sincere; however, the GOL’s foreign policy, particularly at the senior levels, remains somewhat fickle. Libyan leader Muammar al-Qadhafi’s visit to Madrid and Paris last December sparked a surge of pro-European rhetoric in Tripoli – in one instance, Qadhafi threatened to pull Libyan investment from sub-Saharan Africa to redirect to his new European friends.  More recently, though, al-Qadhafi orchestrated a meeting of Arab Maghreb Union leaders in Tripoli to publicly disparage Sarkozy’s Union for the Mediterannean proposal (reftel).  Characterizing the proposed union as “insulting”, he claimed it would undermine Arab and African member states’ commitments to the Arab League and African Union, and told former British Prime Minister Tony Blair he was concerned that the proposal represented an effort by southern European states to create a North African bulwark against illegal migration from sub-Saharan Africa and to “further legitimize” Israel.  Despite such disagreements, Qadhafi’s interest in being taken seriously, particularly by his “friends Nicholas (Sarkozy) and Silvio (Berlusconi)”, will continue to drive the GOL’s keen interest in finalizing a framework agreement with the EU.  End comment.   GODFREY”

Gadhafi Suggests EU-Funded Program to Combat Illegal Immigration

As noted on Euromed-Migrasyl, in an interview with Der Spiegel, Libyan leader Moammar Gadhafi, has suggested that the EU pay Libya €5 billion “to combat illegal immigration”:

“SPIEGEL: In recent years, thousands of people have drowned as they tried to flee from Africa across the Mediterranean to Europe. What can you do to help end this tragedy?

Gadhafi: The European Union should annually pay Libya €5 billion ($6.6 billion) via a special fund to combat illegal immigration. We have a precisely calculated plan to solve this problem.

SPIEGEL: What kind of plan is this?

Gadhafi: We will organize housing and employment projects in the refugees’ African countries of origin so they remain there. We will do the same for those who are already in Libya, give them a place to live and create jobs for them. Furthermore, we are bolstering our border security on land and water with modern radar equipment and vehicles.”

During the interview Gadhafi also called for dissolution of Switzerland and said that his “closest friend in Europe is Italian Prime Minister Silvio Berlusconi.”
